Justification for Other than Full and Open Competition
1. Identification of the agency and the Contracting Activity, and Specific Identification of the Document as a “Justification for Other than Full and Open Competition”

This document is hereby identified as a “Justification for Other than Full and Open Competition” under the authority of FAR 6.302-1. This document sets forth the justification and approval for use of one of the exceptions to full and open competition allowed under the Competition in Contracting Act (CICA) of 1984.
2. Nature and/or description of action being approved.
The switchgear system, at the Mail Facility (GSA Building DC0027ZZ), is currently functioning however the electricity that is received from Joint Base Anacostia Bolling (JBAB) is not clean. The manufacturer of the system (Siemens) recommends an upgrade to the power management system which will help mitigate the power spikes from the base power supply. It is highly advisable that Siemens performs this upgrade because the power management system because they are the only one responsible source. No other supplies or services will satisfy the agency requirements based on the proprietary nature of the property. For this reason, we need to award this directly to Siemens and have them perform this upgrade.
3. Description of supplies or services required to meet the agency’s needs This work is to be provided as needed to include but not be limited to:
Siemens will provide the hardware, software, and engineering required for the WinPM v10.0 installation.

4. Training for site personal.Identification of statutory authority permitting other than full and open competition
41 U.S.C. § 3304(a)(2), Siemens is the only one responsible source and no other supplies or services will satisfy the agency requirements based on the proprietary nature of the property.See also FAR § 6.302-2.
5. A demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited.
In accordance with FAR Section 6.302-2, negotiations will be conducted on a sole source basis with Siemens Industry, Inc. to perform the services to upgrade the power management system.
The GSA Facilities Management Office has determined the contractor’s ability to complete this requirement based on the following:
Siemens Industry, Inc owns the proprietary software required to upgrade the power management system and the technicians to perform this service. The Contractor has the sufficient experience as well, working on the system required by the General Services Administration.
6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized.
Not applicable. See #5 above.
7. A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable.
The GSA Facilities Management Office has prepared an Independent Government Estimate (IGE) in the amount of for the services.
8. A description of the market research conducted and the results or a statement of the reason market research was not conducted.
Market research was conducted but due to the switchgear system is Siemens Industry, Inc. proprietary system, and they are the only company capable of providing the onsite and offsite upgrades to the power management system and software.
9. Any other facts supporting the use of other than full and open competition
Due to the contractor’s familiarity with the requirement, the Government is confident that the award of a stand-alone firm-fixed price contract to this contractor will result in the timely execution of this need.
10. A listing of the sources, if any, that expressed, in writing, an interest in the acquisition
Not applicable.
11. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required.
Normally, procurement actions are handled using full and open competitive procedures for a requirement such as this one. However, because the existing switchgear system is a proprietary system, it is necessary to contract with Siemens Industry, Inc for this requirement to be successful.
