About this file
This document is a Justification for Other Than Full and Open Competition (Simplified Acquisition Procedures) for the U.S. Coast Guard's procurement of marine seats. The document seeks to acquire five (5) SEAT, MARINE, Part Number SWP-1173A (NSN 2090-20-013-9765) manufactured exclusively by Professional Components Ltd. for 22' Coast Guard boats. The justification highlights that the technical data required to manufacture these seats is proprietary and only available from the original equipment manufacturer, making Professional Components Ltd. the sole source.
The procurement is being conducted under 10 U.S.C. § 3204(a)(1) for "only one responsible source and no other supplies or services will satisfy agency requirements." The Coast Guard argues that without access to the original manufacturing drawings, specifications, and tolerances, attempting to produce alternate seats could compromise crew safety during maritime operations. The Contracting Officer of Record, James Taylor, notes that the Coast Guard will continue to conduct market research to potentially locate alternative vendors in future acquisitions, but for this specific procurement, Professional Components Ltd. remains the exclusive source.

BRIEF DESCRIPTION OF SUPPLIES OR SERVICES REQUIRED, AND THE INTENDED USE. The purchase of five (05) each, SEAT.
MARINE, P/N SWP-1173A, NSN 2090-20-013-9765. Vessel: 22’ CBL. The parts are manufactured by SHOCKWAVE SEAT PARTS, dba
PROFESSIONAL COMPONENTS LTD.
UNIQUE CHARACTERISTICS THAT LIMIT AVAILABILITY TO ONLY ONE SOURCE, WITH THE REASON NO OTHER SUPPLIES OR SERVICES CAN BE USED. The technical data required to make an accurate assessment of equal or alternate equipment that could meet the Coast Guard’s performance, form, fit and function requirements for this procurement is unavailable. The SEAT, MARINE, is utilized for the maintenance and replacement of the seats installed on the 22’ CBL, allowing the crew to have a platform when conducting underway operations. The failure of the SEAT, MARINE, could result in having an unstable platform for personnel, especially in rough seas. Any attempt to manufacture this item without the proper Original Equipment Manufacturer (O. E.
M) parts and without access to O.E.M. reproduction manufacturing drawings, specifications, tolerances/parameters, test procedures and other relevant information, could cause injuries to the vessel’s crew. Therefore, any offer of parts shall be “official OEM brand”.
A DESCRIPTION OF EFFORTS MADE TO ENSURE THAT QUOTATIONS OR OFFERS ARE SOLICITED FROM AS MANY POTENTIAL SOURCES AS PRACTICABLE (INCLUDE YOUR MARKET RESEARCH EFFORTS HERE). Researched the Internet for vendors available to provide the SEAT, MARINE. The SEAT, MARINE is provided by PROFESSIONAL COMPONENTS LTD., any offer of parts shall be “official brand OEM” parts. PROFESSIONAL COMPONENTS LTD. is the suggested source that can provide the SEAT, MARINE. PROFESSIONAL COMPONENTS LTD. is the sole possessor of the drawings and other technical information required to properly manufacture the SEAT, MARINE.
PROFESSIONAL COMPONENTS LTD. has no known distributors.
REASON THAT SUGGESTED SOURCE IS THE ONLY SOURCE WHICH CAN PROVIDE THE SUPPLIES OR SERVICES.
The Coast Guard does not have any technical information to deviate from this brand of SEAT MARINE, another vendor’s offer may not have the same form, fit, and function as the installed brand and could lead to fabrication being necessary for installation.
EXPLAIN WHY AN ADEQUATE PURCHASE DESCRIPTION OR OTHER INFORMATION SUITABLE TO SOLICIT BY FULL AND OPEN COMPETITION HAS NOT BEEN DEVELOPED OR ARE NOT AVAILABLE. This is a proprietary commercial item of the proposed contractor. The reproduction of manufacturing drawings, specifications and other technical data related to this item were never purchased by the U.S. Coast Guard and therefore are controlled by and remain the sole property of the OEM.
PROVIDE A STATEMENT OF ACTIONS, IF ANY, THE GOVERNMENT MAY TAKE TO REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE FUTURE ACQUISITIONS ARE REQUIRED. COR will continue to conduct market research in the attempt to locate vendors that can satisfy the needs of the Coast Guard including a requirement for manufacturer’s engineering drawings, detailed parts lists, design or testing procedures, and other relevant information concerning this item.
