JUSTIFICATION FOR AN EXCEPTION TO FAIR OPPORTUNITY

TRANSPORTATION VISUALIZER (TRANSVIZ) FUNCTIONAL MANAGEMENT

21-17

1. NATURE AND/OR DESCRIPTION OF THE ACTION BEING APPROVED.

USTRANSCOM requires a 3-month bridge extension for the JOPES/TransViz Functional Management task order. A firm-fixed priced contract, HTC711-16-F-D029, was awarded to SRA International, which included a base period (15 Mar 2016-30 September 2016) and four 1-year option periods (1 October 2016 - 30 September 2017, 1 October 2017 -30 September 2018, 1 October 2018 - 30 September 2019, and 1 October 2019 - 30 September 2020). The extension of services clause was exercised to extend the contract to 31 March 2021. An extension period of 1 April -30 June 2021 is required to ensure uninterrupted support while the follow-on contract is awarded.

2. DESCRIPTION OF SERVICES REQUIRED TO MEET THE AGENCY'S NEEDS.

USTRANSCOM has a requirement for JOPES functional management, Trans Viz functional management, and research/analysis support for both systems. Core requirements are:

• JOPES Functional Manager personnel shall be able to operate specified applications/systems and shall provide assistance to other USTRANSCOM personnel and components.

• Trans Viz Functional Manager personnel shall be able to operate specified applications/systems and shall provide assistance to other USTRANSCOM personnel and components.

3. IDENTIFICATION OF EXCEPTION TO FAIR OPPORTUNITY AND

SUPPORTING RATIONALE.

The applicable statutory exception for fair opportunity is Federal Acquisition Regulation (FAR) 16.505(b)(2)(i)(A), the agency need for the supplies or services is so urgent that providing a fair opportunity would result in unacceptable delays.

The current contract was awarded under the General Services Administration Alliant 2 Government-Wide Acquisition Contract, and all awardees were given a fair opportunity to be considered.

This requirement was originally planned to be insourced at the conclusion of contract performance. However, outbreak: of the COVID 19 pandemic caused USTRANSCOM to rethink this acquisition strategy. As a result of careful consideration of alternatives, the decision was made to not insource.

TCAQ-D is currently working pre-award required actions for a 4 ½ year follow on award. Any attempt to shorten the duration of the solicitation posting for this effort would result in the inability to receive full and fair response by industry.

Competing an extension to the current task order would result in unacceptable delays as it is not possible to have another contractor step in to provide the required services for 91 days while the follow-on solicitation, source selection, and award are completed.

PWS paragraphs 1.3.2.1. Subtask 1, 1.3.2.2. Subtask 2, and 1.3.2.4. Subtask 4 have been identified as Mission Essential, and break in such service cannot be tolerated. Chairman of the Joint Chiefs of Staff Manual 3122.02, Time-Phased Force Deployment Data Development and Deployment Execution, requires Transportation Componenet Commands manually update lift schedules, movement data, and manifests. If data does not flow to JOPES Supported Combatant Commanders, USTRANSCOM, Services will not have accurate picture of how USTRANSCOM is managing force movement requirements.

4. DETERMINATION BY THE CONTRACTING OFFICER THAT ANTICIPATED

COST TO THE GOVERNMENT WILL BE FAIR AND REASONABLE.

The anticipated cost/price will be determined using price analysis and the independent Government cost estimate which will be based upon pricing from the current contract. The services being acquired are commercial. Funding has been identified in the FY21 operating budget. TCAQ has previously determined the current task order rates to be fair and reasonable.

5. ANY OTHER FACTS SUPPORTING THEJJJSTIFICATIQN,

THE EXCEPTION TO FAIR OPPORTUNITY BEFORE ANY SUBSEQUENT

ACQUISITION FOR THE SERVICES IS MADE.

The re-compete action is currently being worked and will be competed and awarded before the 3-month bridge expires. The solicitation will be solicited for thirty days to obtain a greater amount of competition. A milestone schedule for accomplishing these actions is being created. The Government anticipates the 91-day extension will be sufficient to finalize the solicitation, source selection, and award the follow-on task order.

7. CONTRACTING OFFICER'S CERTIFICATION.

I certify that the justification is accurate and complete to the best of my knowledge and belief.

Based on the above cited justification, I hereby determine the circumstance in FAR 16.505(b )(2)(i)(A) applies to this exception to fair opportunity justification.
