About this file
JOFOC Summary
This is a Justification for Other Than Full and Open Competition (JOFOC) document, also known as a Justification & Approval, submitted by the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) for a sole-source brand name procurement of specialized training ammunition. The document justifies the use of non-competitive procedures under 41 U.S. Code § 3304 and RFO 6.103-1, citing that Ultimate Training Munitions (UTM) is the sole manufacturer of the required ammunition platforms. The requiring agency is ATF's Special Operations Division, with contracting authority vested in ATF's Office of Management – Acquisitions Management Division. The Contracting Officer is James Huff, and the Government Technical Representative is Richard Fitzpatrick. The JOFOC number is LSJ-26-0027, dated September 14, 2026.
The procurement consists of two orders for UTM training ammunition used in mandatory biannual tactical training for Special Agents. The first order (PR DJA-26-ASOD-PR-0114) totals $193,398.40 and includes 80 cases of 9mm UTM UTX ammunition (Part #01-3101) and 98 cases of 556 UTM ammunition (Part #01-0815). The second order (PR DJA-26-ASOD-PR-0568) totals $187,055.47 and includes 87 cases of 9mm UTM UTX and 99 cases of 556 UTM ammunition. All ammunition is specified in red color. Each order has a 180-day period of performance from contract award. The Contracting Officer determined fair and reasonable pricing based on previous purchases from March 2026 and July 2025, as well as a government pricing quote from UTM. Although the ammunition is no longer available on GSA Schedule (removed in FY 2025), three small business distributors were solicited to ensure competitive pricing, with UTM offering the lowest quote. Ammunition will be drop-shipped to various ATF locations throughout the continental United States.

2. The nature and/or description of the action being approved.
ATF has a requirement to train our Special Agents in reality-based force-on-force training to replicate many of the scenarios they will face in performing their everyday duties. On a routine basis, our field offices execute high-risk search and arrest warrants and undercover operations that deal with potentially violent offenders.
To assist our personnel in performing their enforcement duties, our Agents carry the M4 Rifle and the Glock 9mm pistol. At a minimum biannually, each ATF field office is mandated to conduct tactical training, where our personnel are tested and trained in their ability to overcome deadly force encounters. Part of this training involves using training (or “paintball”) ammunition in our Rifles and pistols, in mock scenarios that replicate many of the realistic situations our personnel face. The importance of this life and death training cannot be overstated, and consequently, we need reliable training equipment and ammunition that will give us the safest and most accurate results possible.
Our agency utilizes the UTM 556 Conversion Kit and UTM 556 Ammunition platform to meet this need. Additionally, our Glock pistols are equipped to function with 9mm UTX ammunition.
UTM is the sole manufacturer of this particular ammunition. Our agency currently utilizes this training platform, and this purchase will cover our agencies training requirements. Our agency already uses 9mm UTM UTX ammunition and UTM 556 training ammunition during tactical training, and this purchase will ensure further standardization throughout our firearms and tactics programs. Quotes from three small business distributors were obtained for this requirement, with the lowest price being UTM. This procurement method helps ensure a quality price for the government and the vendor (UTM) is an authorized small business.gov

5. Services: A statement demonstrating the unique qualifications of the proposed contractor or the nature of the action requiring use of the referenced authority.
These two UTM rounds are ATF’s standard marking cartridge rounds. No other marking cartridge is authorized for use on our ATF issued pistols and rifles. All of our Agents are trained on this round and this purchase will further ensure standardization in our Agency.
6. A description of efforts made to ensure offers/quotes were solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by RFO 5.1 and, if not, which exception under RFO 5.201(b) applies.

The anticipated price of this procurement is $187,055.47. The Contracting Officer determined that the anticipated price will be fair and reasonable based on the previous purchase of this same ammunition in March of 2026 and July of 2025 (those Purchase Orders are attached to this procurement package) and by the government pricing quote from UTM (also attached to this procurement package).
8. A description of the market research conducted and the results or the reason market research was not conducted.
Market research was conducted and no federal contract was found available for this purchase and the ammunition is no longer on GSA Schedule (vendor removed it in FY 2025). However, there are several distributors of this ammunition and this requirement was competed amongst small business distributors.
9. Any other facts supporting the use of other than full and open competition.
Recent federal procurement regulations have been updated and streamlined, removing mandates and administrative delays. Under the spirit of this more flexible guidance, three quotes were obtained amongst interested companies, meeting recently updated procurement policy.
10. A listing of the sources, if any, that expressed, in writing, an interest in the acquisition.
N/A
11. A statement of any actions the agency will take to remove or overcome any future barriers to competition.
ATF will continue to first look to existing federal contracts and GSA for our procurements. When these options are not available, we will seek to achieve a fair price by competing the requirement for competition amongst interested companies.
