4. Identification of the statutory authority permitting other than full and open competition:

a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service:

The statutory authority permitting other than full and open competition is Section 201 of the Federal Property and Administrative Services Act of 1949 (40 U.S.C. 501), as implemented by FAR 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements. More specifically, 6.302-1 (b)(1)(i) - unique supplies or services available from only one source or only one supplier with unique capabilities.

5. A demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited:

The USMTM presence in Saudi Arabia represents a unique security assistance and cooperation effort under the authority of the US diplomatic mission. USMTM coordinates security assistance to train, advise, and assist the Saudi Arabian Armed Forces in building defense capacity and capability through military exercises and professional military education in order to promote regional security and to protect common interests of the United States of America and the Kingdom of Saudi Arabia while strengthening strategic partnership. This requirement on behalf of USMTM will help to fulfill the overall mission by providing Architecting, Engineering Operations & Maintenance (AEO&M) services on the Al-Nakhla Residential compound in Riyadh, Saudi Arabia.

The Government will solicit only Abacus Technology since it has been determined that Abacus is the only entity that can provide these services in the Kingdom of Saudi Arabia (KSA) in accordance with a Commercial Registration (CR) from the Saudi Ministry of Commerce.

Commercial Registration licenses the company to perform information technology (IT) services within the provinces of the Kingdom. Abacus is the only known source that holds a current KSA Commercial Registration. Extensive market research found that no other company held the required Commercial Registration in the Kingdom of Saudi Arabia.

Based upon the above facts Abacus Technology is the only source capable of providing the required services to meet USMTM’s requirement in the KSA.

6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable: N/A

7. A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable:

The Contracting Officer will determine that the anticipated cost to the Government for this contract action will be fair and reasonable based on price analysis in accordance with FAR 15.404-1(b). The contracting officer will obtain appropriate data, without certification, on the prices at which the same or similar items have previously been sold and determine if the data is adequate for evaluating the reasonableness of the price. Price analysis may include evaluating data other than certified cost or pricing data obtained from the offeror or contractor when there is no other means for determining a fair and reasonable price. Price analysis techniques will include comparison of proposed prices to historical prices paid for the same or similar services obtained on the current USMTM Eskan Village Communication and Technology Support (EV CITS) task order. If necessary, the prior prices will be adjusted to account for differing terms and conditions, quantities and market and economic factors. In addition, cost realism analysis may be performed on the cost-reimbursable elements of the requirement, per FAR 15.404-1(d).

The GSA Project Manager (PM) will complete a technical evaluation of the contractor’s technical submission to ensure the labor mix and hours are appropriate for the work to be performed.

8. A description of the market research conducted (see part 10) and the results or a statement of the reason market research was not conducted:

This requirement was initially awarded in 2016 under the Alliant GWAC, and the only proposal received was from Abacus Technology Corporation. The current requirement will be solicited on an open market basis, as Abacus no longer holds an Alliant contract or any other Government contract vehicle suitable for this requirement.

Extensive market research was conducted in accordance with FAR 10. Initially, scope reviews were obtained from the Alliant GWAC and IT Schedules programs. The requirement was deemed to be within scope for Alliant, but not compatible with IT Schedule 70. An RFI was subsequently sent to Alliant prime contract holders (July 20, 2020), and informed them of the need to provide a certificate stating their company is authorized to perform work within the Kingdom of Saudi Arabia (KSA) should they choose to respond to the eventual RFQ. Responses were received from GDIT, Perspecta, NJVC LLC, and Telos.

None was able to provide proof of current authorization to work in Saudi Arabia, although GDIT did state that it would engage a sponsorship agent with to provide licenses and permits to conduct business in the KSA on behalf of GDIT.

Research subsequently showed that obtaining a Certificate of Registration to work within the KSA is an extremely time-consuming process, reliant on KSA laws, procedures, and timelines. A final effort to complete market research was the release of an RFI in FebBizOpps (posted August 31, 2020), also highlighting the need for positive written confirmation of holding a current Certificate of Registration with the KSA Ministry of Commerce. Responses were received from two vendors (Principle Information Technology Company (PITC) and O’Ready LLC) but neither indicated positive confirmation of holding a current KSA Commercial Registration and the ability to comply with all host country regulations and directives on expatriate work permits.

It was determined that only Abacus Technology is capable of meeting the USMTM requirement for work in Saudi Arabia, being the only known source currently licensed by the Saudi Ministry of Commerce to perform on the USMTM KSA requirement.

9. Any other facts supporting the use of other than full and open competition:

More recent developments relating to COVID-19, the closure of international borders, and cancellation of inbound flights have further complicated the intended move from Eskan Village to Al-Nakhla. USMTM deems the relocation of operations and all networks, systems, and services as the single most complex KSA mission requirement to date. Abacus will provide continuity and familiarity with systems, regulations, and professional relationships to assist in the relocation effort during this time of uncertainty.

10. A listing of the sources, if any, that expressed, in writing, an interest in the acquisition:

See paragraph (8) above.

11. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required:

The Government will solicit only Abacus Technology. No other firm is capable of performing the required services in the KSA, as Abacus is the only source know to possess a Commercial Registration to work in the Saudi Arabia. In accordance with FAR 17.207, prior to exercising an optional period of performance the Government will review market research to ascertain whether there are potential new sources, although this is considered unlikely. If other fully capable sources arise any future like requirements would be considered for competitive acquisition.
