About this file

This Justification for Other Than Full and Open Competition (JOFOC) document details a procurement action by the Federal Bureau of Prisons' Federal Medical Center in Lexington, Kentucky. The document justifies a sole-source procurement from Federal Prison Industries (UNICOR) for various inmate clothing and supplies, including work boots in multiple sizes, clothing items, blankets, personal hygiene products, and calendars, with an estimated aggregate value of $70,484.10.

The procurement is being conducted under 18 U.S.C. 4124 and FAR 6.302-5(b)(1), with UNICOR listed as a mandatory source. The contracting officer determined that UNICOR's 60-day lead time is reasonable, and their product quality is comparable to private sector alternatives, with pricing significantly lower for the government. The document includes market research findings and certification that the procurement is not the result of poor acquisition planning, with the contract officer Charles Coushaine approving the document on July 30, 2025.

6. Efforts made to obtain competition:

Market research was conducted by reviewing unicors schedule of supplies. Inmate clothing are listed as a “MANDATORY” item.

See file to verify justification.

Per Unicors website, https://unicor.gov/SopAlphaList.aspx, Mandatory:

Mandatory items require Federal customers to give procurement priority to FPI, when UNICOR is able to provide the desired product within the required time frame at a competitive price.

7. Determination of fair and reasonable:

https://unicor.gov/SopAlphaList.aspx

In accordance with FAR 8.602 (a)(1) “(1) Before purchasing an item of supply listed in the FPI Schedule, conduct market research to determine whether the FPI item is comparable to supplies available from the private sector that best meet the Government’s needs in terms of price, quality, and time of delivery. This is a unilateral determination made at the discretion of the contracting officer. The arbitration provisions of 18 U.S.C.4124(b) do not apply.”

Unicors lead time is 60 days. This is determined by the contracting officer to be reasonable.

The quality of Unicor’s products is comparable to those found in the market research, but their pricing for the government is significantly lower.

See market research in the file.

In accordance with FAR 8.602 (a)(2) “(2) Prepare a written determination that includes supporting rationale explaining the assessment of price, quality, and time of delivery, based on the results of market research comparing the FPI item to supplies available from the private sector.”

This JOFOC will serve as my written determination that the prices quoted from Unicor (FPI) are fair and reasonable in accordance with the private sector, in terms of price, quality and delivery.

8. Description of the market research:

Market research was performed by viewing unicors schedule of supplies and similar products I have researched on the internet sold as commercial items.
