This acquisition is conducted under the authorities for procurements under the Simplified Acquisition Threshold (SAT) in accordance with the Federal Acquisition Regulation (FAR) Part 13 for other than full and open competition (including brand name) to meet the agency’s needs.
This does not use the Federal Supply Schedule (FSS), also known as the General Schedule Administration (GSA) Schedules Program or the Multiple Award Schedules (MAS) under FAR Part 8 – Required Sources of Supplies and Services.

2. Nature and/or Description of the action being approved.
ATF intends to award a sole-source, firm-fixed price contract to Utah Communications Authority (UCA) for access to its network (UCAN).
3. Description of the Supplies and/or Services required to meet the agency’s needs (including the delivery schedule and/or period of performance, estimated total value, and all options, if any).
This action is to acquire user identifications (IDs) for 80-subscriber radios to have full-voice, statewide-system access to UCAN to support RSB and ATF’s Denver Division’s radio users assigned to the Salt Lake Field Office. The period of performance is for one (1) base year (July 1, 2023 – June 30, 2024) and four- (4-) option years (July 1, 2024 – June 30, 2028), for a total-estimated cost of $148,529.00.
UCA, a state-government entity, is located on 5215 W Wiley Post Way in Salt Lake City, Utah 84116-2938.
4. Identification of Statutory Authority permitting other than full-and-open competition.
This acquisition is conducted under the authority of 41 U.S. Code § 3304 – Use of Non- Competitive Procedures and the exceptions listed under FAR 6.302 – Circumstances permitting other than full and open competition.
FAR 6.302-1 Only one responsible source and no other supplies or services will satisfy agency requirements.
FAR 6.302-2 Unusual and compelling urgency.
FAR 6.302-3 Industrial mobilization; engineering, developmental, or research capability;
or expert services.

5. A demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited.
To provide the most effective state & local interoperability for public safety throughout the state of Utah, the state procured one (1) statewide Land Mobile Radio (LMR) system via its soliciting/bidding process. (For statewide systems, it is not feasible to procure multiple systems because such would require significant, additional expenses and technology to provide for interoperability between disparate systems, resulting in duplicate services.) To ensure the most effective use of taxpayers’ dollars, states normally have just one (1) statewide communications system. As such, UCAN is the only statewide radio system that provides LMR, interoperable communications with state-and-local, public-safety agencies throughout the state of Utah. ATF needs access to this statewide communication system to support its law-enforcement activities (i.e., responses to emergencies and communicating with other law-enforcement partners using said network).
