About this file
This is a Justification for Other Than Full and Open Competition (JOFOC) document for a sole-source procurement by the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF).
The ATF Special Operations Division seeks to procure 27 Skydio X10 Unmanned Aircraft Systems (UAS), 50 Skydio R10 small UAS, 30 Skydio X10 batteries, 50 Skydio R10 batteries, and 15 Skydio X10 NightSense IR attachments to support law enforcement operations including undercover operations, tactical response, critical incident management, disaster response, and infrastructure inspection. The specific items required include Skydio X10 Starter Kits, Skydio Battery 150W units, Skydio NightSense IR attachments, and Skydio R10 Patrol Kits. The performance period is 120 days from award, with an estimated total acquisition cost of approximately $820,000, including shipping. Rather than pursuing full and open competition, the procurement is being conducted under the authority of 41 U.S. Code § 3304 (Use of Non-Competitive Procedures) using the brand name exception under RFO 6.103-1, justifying the selection based on Skydio's unique 360-degree collision-avoidance capability essential for safe autonomous operation. Although no current federal contract or GSA Schedule listing exists for these systems, the requirement will be posted for competition among authorized small business distributors: ADS, Aquila International, Lyme Technology Solutions, OWT Global, and Seneca Strategic Partners. The document was approved on August 25, 2026, with the Contracting Officer Courtney Middleton and required reviews from the Bureau Procurement Chief and DOJ Senior Procurement Executive, as the anticipated value exceeds the $75 million threshold.

ATF requires a commercially available Unmanned Aircraft Systems (UAS) and Small Unmanned Aircraft System (sUAS) to support law enforcement operations including undercover operations, tactical response, critical incident management, disaster response, infrastructure inspection, and public safety missions.
Specifically, ATF has a requirement for 27 Skydio X10 UAS’s, 50 Skydio R10 small sUAS’s, 30 Skydio X10 batteries, 50 Skydio R10 batteries, and 15 Skydio X10 NightSense IR attachments.
These required systems are made by Skydio and the company information is below:
Skydio, Inc.

There is no current federal contract for these systems, and they are not on GSA Schedule.
Therefore, the requirement will be posted for competition authorized Small Business distributors.

3. A description of the supplies and/or services required, including the delivery schedule response, infrastructure inspection, and public safety missions. Procuring the Skydio X10 and Skydio R10 UAS will ensure compatibility with the agency's existing equipment, software, operational procedures, maintenance program, and training program.
Current federal procurement rules only allow for us to procure American made UAS/sUAS systems.
However, the majority of the UAS systems on the market are made with Chinese technology and parts. Skydio is one of the only UAS manufacturers that is American made meets our operational needs, and while also ensuring standardization in our UAS program.
Market research identified multiple commercial sUAS manufacturers; however, no alternative platform was found that provides full compatibility with the Government's existing Skydio fleet while simultaneously meeting the Government's operational, technical, cybersecurity, and standardization requirements. Procuring an alternate platform would require duplicative equipment, additional operator training, and expanded logistics support, resulting in unnecessary costs and reduced operational efficiency.
For all of these reasons, UAS SME’s have determined that only the Skydio X10 satisfies the Government's needs for this acquisition.
6. A description of efforts made to ensure offers/quotes were solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by RFO 5.1 and, if not, which exception under RFO 5.201(b) applies.
This requirement will be solicited open market on SAM.gov for all authorized small businesses to compete for. This will help ensure a quality price for the government, while also helping us meet small business procurement requirements.
7. The anticipated dollar value of the proposed acquisition, including options if applicable, and a determination by the contracting officer that the anticipated cost to the government will be fair and reasonable.
In accordance with FAR 13.106-3(a) (iii) and (iv), price reasonableness is based on market research and previous purchases of these systems. The overall cost for this purchase will likely be around $820,000. Shipping should be included in the price. Skydio is the sole manufacturer of these systems and there are several authorized distributors that should provide the proper competition.
8. A description of the market research conducted and the results or the reason market research was not conducted.
These are the only UAS/sUAS systems that can be procured by ATF as the components must be American. Market Research conducted by SOD UAS SME’s showed that these particular UAS Systems are allowable, while also meeting ATF operational needs. ATF currently owns and utilizes several of these same UAS systems, which are used extensively during enforcement operations and criminal investigations. This purchase will further standardize our operational capability.
9. Any other facts supporting the use of other than full and open competition.
This procurement is targeted for authorized small business distributors.
10. A listing of the sources, if any, that expressed, in writing, an interest in the acquisition.
SOD recommends the below vendors be made aware of this requirement:

621 Lynnhaven Parkway, Suite 160 Virginia Beach, VA 23452
UEI: GJMSFBCNMSK3
Aquila International 807 B Bay Street Woodbridge, VA 22191
UEI: K4LKHE9DHXR5

11. A statement of any actions the agency will take to remove or overcome any future barriers to competition.
It is ATF’s intent to promote competition when acquiring goods and/or services on behalf of the bureau. ATF utilizes the Federal Acquisition Regulation (FAR) to govern the procurement process.
Competition is sought. However, in the case of logical follow-on work, ATF makes a determination to limit competition in those cases where it is considered to be in the best interest of the Government.
Future orders will be given full consideration of fair opportunity as required by FAR 16.505. The results of the fair opportunity process will be adhered to in accordance with FAR with any known exceptions noted in the contract file.
