JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

NATIONAL NUCLEAR SECURITY ADMINISTRATION

Office of Global Material Security, Nuclear Smuggling Detection and Deterrence

Warehousing Facilities and Related Services March 18, 2022

I. AGENCY IDENTITY AND CONTRACTING OFFICE

Office of Global Material Security, Nuclear Smuggling Detection and Deterrence (NSDD) (NA-213) of the U.S. Department of Energy (DOE), National Nuclear Security Administration (NNSA). The contracting activity is the NNSA Headquarters Service Acquisition Branch (HSAB NA-APM 126).

II. NATURE AND/OR DESCRIPTION OF THE ACTION BEING APPROVED

This document sets forth the justification and approval of the use of one of the exceptions to full and open competition allowed under the Competition in Contracting Act (CICA) of 1984. This contract modification is to add one year with a one-year option period to the current contract for a total potential contract period of 5 years. This modification is planned to be a sole source acquisition to Technology Ventures Inc.

(TVI), 25200 Malvina, Warren, Michigan 48089, to provide Equipment Management Services for specialized radiation detection equipment in support of NSDD.

III. DESCRIPTION OF SUPPLIES AND/OR SERVICES

NNSA intends to extend the current contract 89233119CNA000098 for warehousing and related services for the equipment necessary for the program’s activities. The extension will be one-year with a one-year option period. The program requires warehouse space for separately procured bulk-buy radiation detection systems and components that are assembled by a variety of parties in several locations around the world, and for storage of related equipment both outbound to foreign countries deployed worldwide in the interest of U.S. National Security and for excess/obsolete equipment returning to the U.S. after end of life. The volume of warehousing utilization required is estimated to be approximately 35,000 square feet - or roughly the equivalent size of a small grocery store. Most of this property is in a state of constant motion between collection, assembly, upgrade, deployment, and recovery, in the support of over 150 deployed sites across the world. To a lesser extent, the program’s inventory also supports testing programs for radiation detection equipment at U.S. national laboratories and other research institutions and the necessary logistics required for those efforts. The agency’s needs are best met by having a single hub-like

89233119CNA000098 Page 2 warehousing and supply system that provides a common equipment deployment network for over 150 disparate sites world-wide. This arrangement allows for a strong level of configuration control over the systems themselves as well as providing for consistent expediter, storage, security, safety, and accountability surveillance.

The estimated value of this extension is in the total amount of $2,566,546. The total estimated value of the contract including the extension is $5,416,868.99.

Extension Base (One Year) $1,263,372 Extension Option Period (One Year)

$1,303,174

Total Extension Two-Years $2,566,546

IV. AUTHORITY

The statutory authority permitting other than full and open competition is 41 USC 3304(a)(1), as implemented by the Federal Acquisition Regulation (FAR) Subpart 6.302- 1 entitled “Only one responsible source and no other supplies or services will satisfy agency requirements.”

V. APPLICATION OF AUTHORITY

This work is currently performed under contract 89233119CNA000098 and was awarded competitively under the WOSB Program-FAR 19.1505 on June 28, 2019. As stated in Section III above, most of the property/equipment warehoused in the facility under the contract are in a state of constant motion between collection, assembly, upgrade, deployment, and recovery in support of over 150 deployed sites across the world. In part due to COVID-19 impacts on travel and shipping, NNSA requires an extension of the current warehousing arrangements to mitigate potential risks to the Program. Therefore, TVI is the only responsible source and no other services will satisfy the agency’s requirement to provide storage and logistics.

VI. EFFORTS TO IDENTIFY ADDITIONAL SOURCES

The acquisition was assigned NAICS 493110 -- General Warehousing and Storage in which SBA has determined that WOSB concerns are underrepresented in Federal procurement. NNSA intends to vet potential additional qualified sources for a follow-on solicitation.

VII. DETERMINATION OF REASONABLENESS OF COST OR PRICE

The cost and prices for this extension will be compared to those in the base award, 89233119CNA000098 Page 3 which met the standard for adequate price competition and have been the subject of previous price analysis. Additionally, TVI currently has a GSA Schedule number GS- 10F-0100L upon which pricing will be based. The Government objectives will be established based upon price analysis utilizing a DCAA audit (if necessary), GSA schedule rates, technical specialists, and price analysis inputs.

VIII. MARKET RESEARCH

Due in part to the impact of COVID-19, additional market research was not conducted.

However, NNSA intends to vet potential, additional qualified sources for a follow-on solicitation.
