FEDERAL BUREAU OF INVESTIGATION
FINANCE DIVISION | PROCUREMENT SECTION
JUSTIFICATION
JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION IN ACCORDANCE WITH Federal Acquisition Regulation 13.106-1(b)(1)
Requisition Number: DJF-22-3460-PR-0005118 Date: 8/23/2022 Estimated Contract Dollar Value: $99,700
1. Identification of the agency and contracting activity.
The U.S. Department of Justice, Federal Bureau of Investigation, Miami Division, has prepared this justification for other than full and open competition for the purchase of Tactical Panel Systems (TPS) modular training buildings on behalf of the FBI Miami Division.
2. The nature and/or description of the action being approved, i.e., sole source, limited competition, establishment of a new source, etc.
The request is for the purchase of 136 8’ Modular Wall Panels to include hardware. 11 walk door assemblies to include hardware and system installation. The TPS Training System was purchased by CIRG Tactical Section National Tactical Training Unit in FY2017 that was placed in the Tactical Firearms Training Center (TFTC) at CIRG/TS who redommended the product to FBI Miami. In order to maintain interoperability and compatibility TPS is the only provider of a unified system.
3. A description of the supplies or services required to meet the agency’s needs.
The request is for the purchase of Modular Wall Panels and doorway systems in order to conduct and or support close quarter battle training (CQB), defensive tactics training, pre-planned operational training, tactical medical training, Advanced Law Enforcement Rapid Response Training, Body Worn Camera Training, and Legal Training Scenarios. This system, which will be installed at the address specified in the Request for Quote. The purchase of this material will allow us to configure a venue to simulate houses, office space, schools, hospitals and a countless number of tactical problems FBI Agents/SWAT Operators can expect during critical incidents. The panels shall be Tactical Panel Systems to match the current ones TTU purchased in the past.

4. The statutory authority permitting other than full and open competition.
In accordance with Federal Acquisition Regulation 13.106-1(b)(1), it is hereby determine that the panels listed on DJF-22-3460-PR-0005118 is available from a sole vendor., and competition is precluded as there are no substitutes available.
5. Demonstrate the unique qualifications of the proposed contractor or the nature of the action requiring the use of the authority.
TTU conducted initial testing of the product and recommended it to NTTU, who in turn recommended the product to FBI Miami The product provides a modular system which represents rooms, doorways, hallways and corners in a material that can be reconfigured time and again. It is constructed of a light weight, durable, weather resistant polymer material, which does not require a track system in the ceiling, as other products do. Due to its light weight construction and resilient assembly process it can be reorganized easily, without the use of a forklift or other heavy equipment, in stark contrast to other commercially available systems. Furthermore, with the purchase of the TPS paneling, these panel components are interchangeable. This systems is widely used throughout the FBI, which leverages the familiarity of the system to visiting FBI SWAT deployed to the Miami AOR.
The material or service must be compatible in all aspects (form, fit, and function) with existing systems presently installed by TTU. The current equipment is Tactical Panel Systems, and the new item/service must coordinate, connect, or interface with the existing system by modular system which represents rooms, doorways, hallways and corners in a material that can be reconfigured time and again. constructed of a light weight, durable, weather resistant polymer material, which does not require a track system in the ceiling, as other products do. Due to its light weight construction and resilient assembly process it can be reorganized easily, without the use of a forklift or other heavy equipment, in stark contrast to other commercially available systems. The polymer construction of the TPS Training system makes it weather and chemical resistant. Compared to metal systems which rust and require re-painting or coating, this system will provide years of service, maintenance free. The CIRG Tactical Section National Tactical Training Unit owns the TPS Training System which was purchased during FY2017 that was placed in the Tactical Firearms Training Center (TFTC) at CIRG/TS. In order to maintain interoperability and compatibility TPS is the only provider of a unified system.
6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies.
The only suitable training system for the FBI to purchase is the (TPS) Tactical Panel System.
Based on the requirements of the FAR an intent to sole source will be posted on SAM.GOV.

7. The anticipated dollar value of the proposed acquisition, including options if applicable, and a determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.
The IGE for this requirement based on market research is $99,700. NTTU has purchased a similar system from the same company in the past for $125,000.
8. A description of the market research conducted and the results.
The type of market research that was conducted is as follows:
o Research via the internet into similar systems are not practically available.
Systems similarly in function are not practical, require track systems to be installed in the ceiling, or require forklifts or heavy equipment to install and reconfigure. This is based on google searches. The FBI looked on the GSA Advantage for comparable products and nothing was considered equal or would meet the agencies minimum requirements.
o Test and evaluation process was conducted by the FBI Tactical Training Unit (TTU), who recommended the product to NTTU in 2017. TTU maintains a TPS demonstration area within their training space at the FBI Academy. The purchase of the initial panel module in FY2017 was the beginning phase of implementing a complete panel system for both the TFTC and the TTU warehouse.
9. Any other facts supporting the use of other than full and open competition.
The polymer construction of the TPS Training system makes it weather and chemical resistant.
Compared to metal systems which rust and require re-painting or coating, this system will provide years of service, maintenance free. Additionally, the system is lightweight, which allows it to set up or modified without the use of a forklift of heavy equipment. TPS Panel systems are robust versus competitors who either use wood construction or inflatable construction which will prove unreliable in the South Florida climate and will degrade of time.
10. A listing of any sources that expressed a written interest in the acquisition.
Tactical Panel Systems, P.O. Box 701468, San Antonio, Texas 78270, Telephone number (210) 590-5193

11. A statement of any actions the agency may take to remove or overcome any barriers to competition, if subsequent acquisitions are anticipated.
The Government will continue to research the market to obtain as many available sources as required in accordance with the FAR to ensure that there are other vendors out there that can satisfy this requirement. In addition, the customer will do due diligence in ensuring that barriers to competition are avoided to ensure we obtain the best value for the government.
