2. Nature/Description of Action being approved, i.e., sole source, limited competition, establishment of a contract:

The ATF SRT Program currently has three (3) Micro Tactical Ground Robots (MTGR) that deploy on SRT operations. SRT personnel are fully trained in their use and capability. The

Robots have become a huge asset to our program since they were first put into use back in 2018.

This purchase will ensure that all of our Teams have this vital piece of equipment. The purchase of two (2) additional MTGR Robots, will give each of our SRT Teams the capability to use these

Robots to gather intelligence and be used in hostage/barricade operations.

RoboTeam (the manufacturer of this Robot) has no distributors or authorized resellers. They are a Sole Source vendor, and they are the only company that can provide the required brand name equipment. This equipment is required for ATF SRT to meet its mission needs.

3. Description of Supplies/Services to include the period of performance and estimated value (including options):

In 2017 and 2018, ATF SRT identified and created requirements for a new tactical robot that would meet the needs of the SRT program for the foreseeable future. Market research was conducted, and after review of the vendor submissions that were advertised on FedBid Buy to

“meet or exceed” the ATF requirements, only one vendor met all of the requirements, RoboTeam

Micro Tactical Ground Robot (MTGR). Each Robot submission was compared against the published ATF requirements and scored accordingly.

The Robo-Team MTGR was the only robot that met the critical requirements of weight and operating frequency.

1. Weight must be under 30 lbs. The requirement for a Man-Portable robot was developed to include all of the other weight that an operator has to carry.

2. Operating frequency of the robot has to operate in government owned and regulated frequencies in S-band (2200-2290 MHz) and/or C-band (4400-4900 MHz). The commercial Wi-Fi frequencies are not acceptable due to contention in high use environment that operations normally occur.

Our SRT currently uses the below Tactical Robot, and only the below Robo-Team will be acceptable to our program

2 year warranty and 2 year support

On-site equipment training when the Robots are received by ATF. Location will be at the discretion of the Agency.

Designed for military and law enforcement purposes, the MTGR is lightweight, highly maneuverable, and provides video and audio capability. The MTGR gives us the ability to conduct a building search from a safe distance away, helping ensure Agent safety.

The MTGR is also weatherproof and meets IP65 standards. All transmissions by the MTGR are secure (encrypted) which will avoid the probability of intercept by the target, public and/or media.

The Period of Performance will be 180 days from Award.

The estimated value of the two Robots is $164,700.

5. Demonstration of Contractor’s Unique Qualifications or Nature of the Acquisition that Requires use of Authority Cited:

The specific characteristics detailed above are what Robo-Team brand equipment provides that no other brand can offer. ATF has been using MTGR robots for our program since 2018, and they are the only authorized Tactical Robots in use by our agency during enforcement operations.

Additionally, SRT members are fully trained on their use and capability, and the purchase of any other Robot System would be cost prohibitive and adversely affect mission readiness.

The Robo-Team MTGR was the only robot that met the critical requirements of weight and operating frequency. (see above)

ATF is a principal law enforcement agency within the United States Department of Justice dedicated to protecting our communities from violent criminals who illegally traffic, possess, and use firearms, use explosives for criminal purposes, and engage in deadly acts of arson. In accordance with FAR 13.106-1(b)(1)(i) and (ii) - Only one source is reasonably available.

Additionally, only one source is capable of providing the supplies or services required at the level of quality required, because the supplies or services are unique or highly specialized. RoboTeam has no distributors or authorized resellers. This procurement will be executed by awarding a Sole

Source to RoboTeam, as only RoboTeam will satisfy the agency’s requirements.

6. Description of efforts made to ensure that offers were solicited from as many potential sources as practicable. Include whether or not a FBO announcement will be issued and attach a draft of the FBO notice. Include any exception under FAR

5.202. when not synopsizing. If any/similar requirements are anticipated in the future.

This approved Justification and Approval for Other than Full and Open Competition (JOFOC) will be posted in Beta.SAM.GOV showing our notice of intent to award a Firm Fixed Price (FFP), sole source purchase order in accordance with FAR 13.106-1(b)(1)(i) and (ii) to RoboTeam.,7529

7. Determination by the Contracting Officer that the anticipated Dollar Value, including options demonstrates of fair and reasonable cost.

The anticipated dollar value of this purchase is estimated to be $164,700

In accordance with FAR Part 13.106-3(a)(2)., proposed pricing from RoboTeam is deemed fair and reasonable. A comparison of the proposed price from previous purchases found it to be fair and reasonable. The Contracting Officer has concluded that the order represents the best value (as defined in FAR 2.101) and results in the lowest overall cost alternative (considering price, special features, administrative costs, re-training personnel, etc.) to meet the Government’s needs. SOD has discussed the attached quote with amongst our SME’s and we have also deemed the quote to be fair and reasonable.

8. Market Research:

In 2017 and 2018, Market Research has been performed by ATF SRT. This research was conducted through hands on demonstrations by various manufacturers, review of manufactures specifications, regional tactical operators meetings, and existing government contracts and through the review of other government operational oriented assessments. The results of this market research found that RoboTeam to meet the requirements of the SRT Robot. Due to this unique and specialized equipment, there are no other companies capable of meeting this need.

RoboTeam has no negative findings for defective pricing or past performance listed in CPARS.

They are active in SAM and not on the excluded parties list.

We continue to stay engaged with all of our federal law enforcement partners as we share ideas and knowledge on related topics such as this. Additionally, our personnel attend annual law enforcement expositions and trade shows, such as National Tactical Officers Association and the

Shot Show. All of this information is gathered and analyzed by our personnel to help ensure we are procuring the best services for our agency.

11. Actions Taken to Remove Barriers to Competition:

ATF will continue to conduct market surveys and research through industry shows and technology releases in the form of papers and journals. This will be used to identify potential sources on subsequent acquisitions. If potential sources are identified, it will be necessary to submit to both extended compatibility and eventual validation studies, but due to the technical and specific nature of these courses, no other vendor has been found at this time.
