FEDERAL BUREAU OF INVESTIGATION
FINANCE DIVISION | PROCUREMENT SECTION
JUSTIFICATION AND APPROVAL (J&A) FOR OTHER THAN FULL AND
OPEN COMPETITION
JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION IN ACCORDANCE WITH (STATE
AUTHORITY 41 U.S.C. 3304(a)(1)
Requisition Number: DJF-21-0700-PR-0001625
Date: 04/01/2021
Estimated Contract Dollar Value: $X,XXX,XXX
1. Identification of the agency and contracting activity.
The U.S. Department of Justice (DOJ), Federal Bureau of Investigation (FBI), National Acquisition Programs Unit (NAPU), has prepared this justification for other than full and open competition to acquire Nikon D-780 Cameras, Associated Components and Accessories on behalf of the Evidence Response Team Unit (ERTU), Laboratory Division.
2. The nature and/or description of the action being approved, i.e., sole source, limited competition, establishment of a new source, etc.
The proposed action is to acquire Nikon cameras, associated components, and accessories for use by the Evidence Response Teams (ERTs) in the field offices. This procurement will be advertised on the beta.SAM.gov website as a brand name only, open market requirement. Authorized resellers of the Nikon Brand will be encouraged to submit a competitive quotation. The resultant contract is intended to be awarded as a single-award, firm-fixed price, Blanket Purchase Agreement (BPA) with a Base Plus Four Options. The total amount of all orders placed against the Agreement shall not exceed $X,XXX,XXX for the life of the BPA.
ERTU requires brand name specific camera equipment from Nikon. In past years, the Laboratory Division has made major purchases of Nikon digital cameras. Those cameras were issued to field ERT teams and are also used by ERTU to conduct training. The current version of Nikon cameras have reached the end of their useful life. They are no longer supported by Nikon and as such, repair components are not readily available. These cameras and the associated equipment are required to fully upgrade the field teams and the training program to the latest technology. The equipment being purchased on this order meets the requirement of being compatible with all of the Nikon equipment that has already been purchased and distributed. ERTU has met with the Laboratory Division’s Operational Projects Unit and several experienced Field Photographers and was notified the current camera recommended for field operational deployment is the Nikon D-780.

3. A description of the supplies or services required to meet the agency’s needs.
This justification is to purchase the components for Nikon D-780 Digital Single Lens Reflex (DSLR) Cameras and necessary components and accessories. The components and accessories consists of: Rechargeable Li-ion Battery EN-EL15b, MH-25a Quick Charger, Body Cap, Camera Strap, Video Cable, USB Cable, LCD Monitor Cover, Nikon Software Suite CD-ROM, and a one year Nikon Warranty, a Nikkor 24-120mm f/4G ED VR Zoom Lens, Nikkor 60 mm Lens, spare Rechargeable Li-ion Battery EN-EL15b, SB-910 Speedlight Flash, MCDC2 Remote Trigger Release, and SC-29 TTL Coiled Remote Cord.
4. The statutory authority permitting other than full and open competition.
The statutory authority permitting other than full and open competition is 41 U.S.C.3304 (c)(1) as implemented by the Federal Acquisition Regulation (FAR) Subpart 6.302-1 entitled, “Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.” – Application for Brand Name.
5. Demonstrate the unique qualifications of the proposed contractor or the nature of the action requiring the use of the authority.
It is necessary that the ERTU purchase the Nikon digital camera. Specific standards for digital photography have been developed and agreed upon for photographing evidence. The Operational Projects Unit and the Forensic Imaging Unit of the Laboratory Division have agreed that Nikon digital cameras meet or exceed requirements for high resolution in order to be able to take photographs that render the most detail. The model of camera that fills this requirement is the Nikon D-780 which has a full frame digital sensor with an effective resolution of 24.5 megapixel.
The SB-5000 Flash units are designed to work seamlessly with the D-780 cameras, specifically in advanced light balancing modes such as TTL (Through The Lens) Matrix metering. This mode of operation allows the flash unit to take in information through the lens and calculate the amount of light the flash needs to produce to achieve the optimum image. The Nikkor 24-120mm f/4G ED VR zoom lens has VR image stabilization and a constant f/4 aperture throughout the zoom range.
This lens affords the user the opportunity to photograph a wide array of scenes and locations with a single lens.
The 60mm standard macro lens is a necessity for every ERT kit as this lens is the norm for close-up, evidentiary photography.
The other items being purchased are all standard accessories that need to be used to properly operate the cameras and lenses described above. These items include spare batteries for the D-780 camera, remote trigger release, and coiled remote cord. The remote trigger release is used in low light or long exposure situations to operate the camera without touching it, thereby keeping the
DJF-21-0700-PR-0001625 Version 2.2 Page 3 of 4 camera from shaking or moving. The coiled remote cord is needed to operate the SB-910 flash unit in an off the camera configuration. This allows the operator to utilize the flash for oblique lighting of an object to better enhance the quality of the photograph.
In past years, the Evidence Response Team Unit and has made a couple major purchases of Nikon digital cameras. Those cameras were issued to field ERT teams and are also used by ERTU to conduct training. These cameras have reached the end of their useful life.
6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies.
This requirement will be posted on the beta.SAM.gov website, as a brand name only, open market requirement. This announcement will give an opportunity for authorized resellers of Nikon brand products to demonstrate their ability to meet the FBI’s specific needs through a submission their technical capabilities and cost information.
7. The anticipated dollar value of the proposed acquisition, including options if applicable, and a determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.
The anticipated dollar value of this award shall not exceed $X,XXX,XXX. The BPA will have a Base Plus Four Options. Prior to issuing an award, the Contracting Officer will determine that the proposed price is fair and reasonable in accordance with FAR 13.106-3.
8. A description of the market research conducted and the results.
Searches for digital cameras have been conducted by speaking with vendor representatives and conducting research on the Internet. Information has also been obtained from the Operational Projects Unit at the Laboratory Division. Personnel from those units have attended trade shows in the US and Europe and have conducted extensive research on the Internet. Nikon is the required manufacturer. The D-780 is the brand of camera required.
9. Any other facts supporting the use of other than full and open competition.
Please see section five (5) above.
10. A listing of any sources that expressed a written interest in the acquisition.

11. A statement of any actions the agency may take to remove or overcome any barriers to competition, if subsequent acquisitions are anticipated.
The actions of the ERTU to identify potential sources possessing the ability to satisfy this and similar requirements are ongoing. Over time, additional sources may become available and identifiable through market surveys, trade shows, magazine articles, collaboration with other Federal agencies, or other means. The ability to predict this possibility is difficult. Therefore, the barriers to competition they impose are impossible to avoid.
