4. Statutory Authority Permitting Other than Full and Open Competition: 41 USC §3304(a)(5), 38 U.S.

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable, including whether a notice was or will be publicized as required by subpart
5.2 and, if not, which exception under 5.202 applies:
The proposed contract action is for a follow-on contract, and as such, services must begin on 11 December 2021. Because the healthcare facility requires the janitorial services to continue without a disruption in services, it is critical to have a new contract before 11 December 2021. If the VA were to utilize another SDVOSB contractor other than the incumbent, there would be a high risk in delay in services. A new contractor would need to have all their employees cleared through the VA’s security systems and receive the required training and facility introduction before services can commence. Security clearance alone takes several weeks, and as such, jeopardizes the time in which the janitorial services can continue. As such, the VA has determined that it is in its best interest to continue the janitorial services utilizing the incumbent contractor, HamHed LLC, on a follow-on contract.
The Justification for Other than Full and Open Competition will be posted to Contracting Opportunities as required by FAR 8.405-6(a)(2)(i).
7. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable: The Contracting Office will take the following steps to ensure that the proposed price for the follow-on contract will be fair and reasonable:
Compare the proposed price to the historical prices on task order Compare the proposed price to the prices found through market research Compare the labor rates used in the proposed price to the published labor rates on the GSA contract Seek additional discounts where applicable
The price determination will be documented in the contract file.
8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted:
Searches through mandatory sources, AbilityOne and UNICOR, revealed that both sources cannot be utilized for this procurement. Searches through existing VA and NAC contracts revealed that though there are several contract vehicles in place for janitorial services, these contract vehicles have been restricted to specific healthcare systems or NCO’s outside of NCO 21. This prevents NCO 21 from utilizing those contract vehicles for this procurement.
Searches through other government-wide contract sites, such as the General Services Administration (GSA), revealed a GSA multi-award schedule (MAS) under Category 561210FAC – Facilities Maintenance and Management that can be utilized for this procurement. This MAS provides services for the complete operation and maintenance of facilities; these services include janitorial and housekeeping services. Further investigation revealed 59 Service-Disabled Veteran- Owned Small Business (SDVOSB) vendors listed on this MAS; the incumbent contractor, HamHed LLC, is one of the scheduled SDVOSB vendors on this MAS.
Though searches through the SBA Dynamic Small Business Search (DSBS) tool revealed two Women- Owned Small Businesses (WOSB) that appear capable of meeting this requirement, the SDVOSB socio-economic category takes precedence within VA procurement as directed by the Veterans First Authority pursuant to VAAR 810.7007. Therefore, it is not anticipated that either WOSB located under the SBA DSBS will be utilized for this procurement.
