3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used:
Hospital HVAC systems have very strict requirements to regulate the pressure, air flow, temperature, and humidity settings in operating rooms to prevent patient infections. If the parameters for each setting is not correct, the operating room cannot be utilized. The HVAC system at VA Southern Nevada HCS is not operating correctly, which is causing the pressure, air flow, temperature, and humidity settings to fall out of parameters. As such, eight operating room suites are not being used at 100% capacity, causing several surgeries to be delayed, scheduled, or cancelled, which is harming our Veterans and jeopardizing patient care.
The recommended contractor, Patriot Air Conditioning LLC, has worked with the HVAC system at the VA Southern Nevada HCS before; thus, the company already has intimate knowledge of the system and hospital drawings. In addition, the company has the technical experience and trained staff to accomplish the required service repairs. If the VA were to solicit services from other companies, the VA would suffer serious injury due to the delay in getting the repairs started and the operating rooms operating at full capacity, threatening the lives of the Veterans who need surgeries.
4. Description of market research conducted and results or statement why it was not conducted:
Search through the VIP Database under the applicable NAICS and PCS revealed 22 verified SDVOSB/VOSB firms. Patriot Air Conditioning LLC (SDVOSB) is one of the identified firms. Due to the urgent and critical nature of the required services, the VA would be seriously injured if it were to solicit quotes from these firms; thus, the VA’s Rule of Two cannot be met for this requirement.
Searches through mandatory sources, AbilityOne and UNICOR, revealed that both sources cannot be utilized for this procurement. Similarly, searches through existing VA and NAC contracts revealed that no existing contract vehicles can be utilized for this procurement.
