DEPARTMENT OF TRANSPORTATION

FEDERAL HIGHWAY ADMINISTRATION

JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

1. Identification of the agency and the contracting activity

The United States Department of Transportation (USDOT) Federal Highway Administration (FHWA) Headquarters, Office of Acquisition and Grants Management, 1200 New Jersey Avenue, S.E., E65-101, Washington, DC 20590.

2. Nature and/or description of the action being approved

This justification for other than full and open competition is to issue a non-competitive modification under Contract No. DTFH6117D00005 with Engineering & Software Consultants, Inc. entitled, “Technical Support for the Infrastructure Analysis and Construction Team.” The proposed modification is to increase the ceiling of the single award Indefinite Delivery Indefinite Quantity (IDIQ) contract by $1,520,000, from $7,600,000 to $9,120,000.

The single-award ID/IQ contract was awarded to support the Turner Fairbank Highway Research Center (TFHRC) on 06/09/2017 with an ordering period of five years and a completion date of 06/08/2022. To date, the Government has awarded 16 task orders with a total value of $6,918,860. As such, there is $681,140 in ceiling remaining to issue new task orders with approximately 17 months left in the performance period under the IDIQ. Therefore, the proposed modification to increase the ceiling is necessary to have enough capacity within the ID/IQ ceiling to issue any required task orders to continue support services while TFHRC determines whether it will work to issue a follow-on award for similar services. This justification does not contemplate any additions or revisions to the ID/IQ scope of work or period of performance. The contractor shall continue providing technical support services under the established competitively awarded ID/IQ.

3. Description of the supplies or services required to meet the agency’s needs (including the estimated value)

This JOFOC does not contemplate any additions or revisions to the ID/IQ scope of work or period of performance. The contractor shall continue providing technical support services under the established competitively awarded ID/IQ.

Originally planned to support only Office of Infrastructure Research & Development’s Infrastructure Analysis and Construction (HRDI-20) Team, the contract also provides in-scope support services to other Program Office teams such as Office of Infrastructure R&D Long Term Infrastructure Performance (HRDI-30), Office of Preconstruction, Construction and Pavements Pavement Design & Performance (HIAP-20), and Office of Technical Services Construction and Project Management (CPM-TST) within FHWA, Rates and established performance periods remain unchanged as competitively awarded under the established ID/IQ ordering procedures where FHWA determined them to be fair and reasonable.

8. Description of the market research conducted and the results or a statement of the reason market research was not conducted

The proposed modification increases the ceiling of the ID/IQ with no effect on competitively awarded rates, performance periods, or change in scope. If it is determined that the effort will be re-competed in the future, market research will be conducted at that time.

9. Other facts supporting the use of other than full and open competition

No other facts are needed and none are known.

10. A listing of the sources, if any, that expressed, in writing, an interest in the acquisition.

There were no inquiries or interest expressed in this contract modification.

11. Statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required.

The FHWA will continue to review vendors, inquire with key federal partners and with other organizations as to their activities and plans for development. Also, FHWA will review organizations that provide similar services on an ongoing basis in preparation for when and if FHWA determines it will re-compete for these services in the future.
