This acquisition is conducted under the authorities for procurements under the Simplified Acquisition Threshold (SAT) in accordance with Federal Acquisition Regulation (FAR) Part 13 for other than full and open competition (including brand name) and not using Federal Supply Schedule (FSS) also known as the GSA Schedules Program or the Multiple Award Schedules (MAS) and FAR Part 8 – Required Sources of Supplies and Services to meet the agency’s needs.

2. Nature and Description of Action Being Approved. Describe the action being approved include the name and address of the proposed contractor(s).
This Justification for Other than Full and Open Competition (JOFOC) authorizes and approves the issuance of a Brand Name justification, firm-fixed price purchase order for the purchase of explosives/explosive supplies.
3. Description of Supplies and Services. Describe the supplies/services to be acquired.

The Required Delivery Date (RDD) will be no later than 90 days.
4. Identify statutory authority permitting limiting sources FAR 13.106(b)(1)(ii).
The Brand Name is essential to the Government’s requirement.
ATF’s Advanced Explosives Disposal Techniques (AEDT) is an eight (8) day (65 hour) course that will provide best practices for safe disposal of deteriorated explosives, unknown energetic powders, pyrotechnics, and specialty items such as oil well perforators. The purpose of this course is to provide the audience members with additional techniques that have been put to test and proven to be safe, not only for the operators, but for the community and environment as well.
The course is highly interactive and requires the applicants be a full-time ATF Certified Explosives Specialist (CES) and/or public safety official trained as a Bomb Technician and whose mission includes destruction/disposal of explosive materials. Military EOD personnel are also welcome.
This course stresses interoperability between the aforementioned explosive disciplines to ensure proper communication and understanding of different advanced disposal techniques. Part of this training course provides techniques by utilizing the specific brands of explosives that are required for specific teaching points and for training consistency between classes.
5. A statement demonstrating the unique qualifications of the proposed contractor or the nature of the action requiring use of the authority.
The aforementioned explosive brand is required to illustrate a specific teaching point which enhances the current curriculum of the AEDT course.
AEDT utilizes multiple different manufacturers of explosives. Our curriculum addresses multiple different types of explosives. The shot layouts have been designed for disposal and the accompanying mathematical calculations necessitates a specific brand be used (in this case Dyno Nobel). If we constantly use different types of explosives for our shots, we lose continuity within the program and would continually have to amend training aids and curriculum. Explosives manufacturers use different explosives and different ratios of explosives, it is their proprietary mix. Different parts of the course address different manufacturing companies thus addressing the need for different brand name high explosives.
In addition, the requirement to familiarize the different disciplines with the specific explosives will contribute to the consistency between class deliveries and provides an environment of interoperability, which is a key objective of the training.
