About this file

This justification and approval document seeks other than full and open competition for the installation of underground communications manholes and conduits for the Chief of Mission Residence in Djibouti. Critical infrastructure was found defective during construction requiring accelerated work by the original American contractor currently in country with necessary manpower, materials, and equipment. The Department of State requirement includes installing three communication cable conduits, three manholes, and two pull boxes for an estimated $189,864.98. An unusual and compelling urgency exists to have the work completed prior to the new Ambassador's arrival by the contractor already familiar with the building and grounds to avoid voiding the construction warranty. No market survey was conducted due to the urgency and the contractor sensitivity of the infrastructure.

JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL A D OPEN

COMPETITION (OVERSEAS CONTRACTING ACTIVITIES)

1. I recommend that Embassy Djibouti to use other than fu ll and open competition for the installation of underground communications manholes and conduits for the Chief of Mission Residence (CMR). The cost for this work is $189,864.98.

2. Nature and/or description of the action being approved:

The action is to acquire general contractor services to install three communication cable conduits and three manholes and two pull boxes.

3. A description of the supplies or services required to meet the agency' s needs:

The installation service is urgently needed to provide the infrastructure for communications and technical security equipment critical for the operation of Mission and security fo r CMRfacilities.

4. An identification of the statutory authority permitting other than full and open com petition.

The requirementsfor a justification fo r other thanfull and open competition (JOFOC) to support use of these authorities are in FAR 6.302-2 Unusual and Compelling Urgency under JO USC 2304 (c)(2) and 41 USC 3304(a)(2) authorities.

5. A demonstration that the proposed contractor's unique qualifications or the nature of the acquisition requires use of the authority cited (for sole source acquisitions; also required for unusual and compelling urgency where more than one offer will not be solicited).

Post recently completed the construction of a new CMR; however, critical infrastr ucture was fo und lo be defective during construction and a change order with the general contractor was not able to be completed in time. A new Ambassador is scheduled to arrive in timeline that will require accelerated schedule. Critical communications equipment must be in place prior to the Ambassador arrival. Additionally, the new building and grounds are still under construction warranty. Any work done in the building by other contractors, or the Government will void this warranty.

6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable. The description should include whether a FcdBizOpps notice was or will be publicized, as required by FAR 5.2, and if not, which exception under FAR 5.202 applies (e.g., blanket waiver provided in

DOSAR 605.202-70).

The source for this acquisition is the American contractor that constructed the CMR. Th is source already has manpower, materials, and equipment in country. The proposal will

not be p ublished in FedBizOpps due to the unusual and compelling urgency of the situation.

7. A determination by the Contracting Officer (CO) that the anticipated cost to the Governm ent will be fair and reasonable.

CO has confirmed the quotation prices are fair and reasonable.

8. A description of the market survey conducted and the results or a statement of the reasons a market survey was not conducted.

Post did not conduct a market survey for two reasons: I) unusual and compelling urgency of the acquisition, and 2) the requirement for an American contractor due to the sensitivity of the infrastructure/facilities, and 3) long timelines that do not meet the required accelerated schedule.

9. Any other fac ts supporting the use of other than full and open competition.

The proposed company is the only American company currently in Djibouti that can provide the required construction expertise.

10. A listing of sources, if any that expressed, m writing, an interest m the acquisition.

None

11. A statement of the acti0,ns, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required.
