Memo to File – Documentation to Explain the Absence of Competition for Lease Extension
This memorandum documents the justification for extending Lease Number LIN16445 without competition under the Simplified Lease Acquisition Threshold (SLAT). The lease, which expires August 8, 2026, requires a 60-month extension as outlined in the project's Acquisition Plan (Project Number 5IN0178). The estimated net annual rent falls within SLAT limits, permitting the extension without full and open competition. The extension is authorized under GSAR 570.405.
The contracting officer selected a cost-based rationale to justify the non-competitive action. The justification states that lease extensions are necessary short-term contracting actions to protect government occupancy rights when the agency cannot vacate by the existing contract expiration date. Extensions avoid holdover tenancy costs and relocation expenses that could not reasonably be recovered through competing a separate short-term lease. The document indicates the agency occupying the space has encountered documented delays in planning for potential relocation to other federally controlled space due to organizational, financial, or other uncertainties. The memorandum was prepared by Chynita Richards and approved by Thomas Nisivaco, with signature and date blocks provided for both parties.

Cost based rationale
Lease extensions represent short-term contracting actions which are necessary to protect the occupancy rights of the government when the government cannot vacate the premises by the expiration of the existing contract term.
Extensions avoid the costs associated with holdover tenancies. Additionally, the government cannot reasonably expect to recover the costs associated with relocation of the tenant agency through full and open competition of a separate short-term lease to cover the term of this extension.
Mission based rationale
The agency’s mission for this location requires a unique location and cannot be satisfied through any alternative locations. The agency’s mission and justification for a unique location is summarized below:
