About this file

This document is a Justification and Approval (J&A) for Other Than Full and Open Competition for the acquisition of 13 units of the Zoll AED defibrillator. The estimated cost is $35,000. The Health Unit at U.S. Embassy Zagreb requires these defibrillators to be placed throughout the embassy due to the current units' batteries expiring in August. The justification cites 41 USC 253(c)(1), indicating that the Zoll AED is the only responsible source that can meet the agency's requirements. The contracting officer conducted market research, which showed that the vendor Med Pharm Trading can meet the technical specifications, offer faster delivery, and provide a lower price than other vendors. The J&A will be published on beta.SAM.gov in line with FAR 11.105, as the purchase is critical to the embassy's security mission operations.

JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN

COMPETITION (OVERSEAS CONTRACTING ACTIVITIES)

1. I recommend that U.S. Embassy Zagreb use other than full and open competition for the acquisition of 13 pcs of defibrillator ZOLL AED. The estimated cost is

$35,000.00 USD (based on the market research).

2. Nature and/or description of the action being approved.

The Health Unit is requesting that we purchase Zoll AED+ defibrillators as they need to be placed in various areas within the embassy in the event that they are needed.

3. A description of the supplies or services required to meet the agency’s needs.

As noted above, the Office of Medical Services in DC only recommends this type of defibrillator.

The batteries and life on the current ones at the embassy will expire in August and this will cause a life/health/safety issue if not replaced.

4. An identification of the statutory authority permitting other than full and open competition

41 USC 253 (c)(1) ONLY ONE RESPONSIBLE SOURCE AND NO OTHER

SUPPLIES OR SERVICES WILL SATISFY AGENCY REQUIREMENT

5. A demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited (for sole source acquisitions; also required for unusual and compelling urgency where more than one offer will not be solicited)

As a part of the market research Procurement Office has reached to following vendors and has received following response;

Vendor Response Model Price Delivery

1 Kardian Quote received Zoll AED+ 32,518.88 30 days

Med Pharm Trading

Quote received Zoll AED+ 26,428.70 20 days

All received quotes are meeting the requesting’s office needs, however vendor Med

Pharm can meet the technical specification requirements, offers faster delivery and offers lower price.

6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable. The description should include whether a

BetaSam.gov notice was or will be publicized, as required by FAR 5.2, and if not, which exception under FAR 5.202 applies (e.g., blanket waiver provided in DOSAR 605.202-70).

As the purchase requirement implies brand name justification for brand regardless of dollar value this justification will be published in BetaSam in line with FAR 11.105.

The purchase is critical to Security Mission Operations and the risk of prolonging this purchase could result in security threats.

7. A determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.

The Contracting Officer believes the cost to the USG is fair and reasonable due to comparison of same/ similar vehicles on the market.

8. A description of the market survey conducted and the results or a statement of the reasons a market survey was not conducted.

A market survey was conducted as further explained under paragraphs 5 and 6.

9. Any other facts supporting the use of other than full and open competition.

N/A

10. A listing of sources, if any that expressed, in writing, an interest in the acquisition.

Further explained under paragraph 5.

11. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required.

None.
