About this file

This is a Justification for Other Than Full and Open Competition (JOFOC) document for a sole-source procurement by the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF).

The ATF Forensic Crime Gun Intelligence Laboratory seeks to award a firm-fixed-price follow-on purchase order to North Star Imaging Inc. for preventive maintenance and software support of a North Star Imaging X3000 Industrial 2D Digital X-ray CT Scanner System (Serial #19021662) located at the ATF Forensic Science Laboratory in Ammendale, Maryland. The contract includes two scheduled preventive maintenance visits per year with comprehensive services including equipment inspection, cleaning, parts replacement, high voltage system adjustments, safety testing, radiation safety surveys, imaging system alignment verification, and software maintenance. All work must be performed by North Star Imaging-certified service technicians, with all replacement parts factory-certified by the original equipment manufacturer. The acquisition covers a base year (September 1, 2026 through August 31, 2027) plus four option years through August 31, 2031, with a total anticipated cost of $132,644. The justification cites 41 U.S. Code § 3304 and RFO 6.103-1 as authority, establishing that North Star Imaging is the sole responsible source because it is the exclusive designer, manufacturer, integrator, and authorized servicer of the X3000 system, with proprietary software (etX-DR, View, and etX-CT) and exclusive distribution rights in the United States. The contracting officer determined the pricing is fair and reasonable based on comparison to an independent government cost estimate and historical award information. A sole-source notice will be posted on SAM.gov upon approval, though no competing responses are anticipated.

11. A statement of any actions the agency will take to remove or overcome any future barriers to competition.

The Bureau makes every effort to remove or overcome any baiTiers to competition before any subsequent acquisition of the supplies or services required. AMD will continue to utilize bidding websites as well as other competitive procedures to promote competition to the maximum extent practicable.

The Government will continue to research the marketplace and communicate with other agencies, to determine if similar products and/or services can meet their needs in the future to remedy the restricted competition regarding future requirements of this technical nature. In the future, the Government will document the evaluation and cost comparison of other CT X-ray systems to include requesting demonstrations, pricing, lifecycle costs, transition costs, etc. in future performance period and consider future competition. However, if the purchase of future scanners is for North Star products, competition will most likely depend on whether North Star authorizes any potential resellers to provide maintenance and support.
