About this file

This document is a Justification and Approval for Other Than Full and Open Competition (JOFOC) for the U.S. Embassy Baku's acquisition of filter set and spare parts for whole house water filtration systems. The procurement request (PR15348365) is for replacement filter sets and spare parts from B DAVID COMPANY INC, with a total cost of USD 18,136.98. The justification is based on the unique compatibility of the existing water filtration systems, which can only use components from B DAVID COMPANY INC, making them the sole responsible source.

The document outlines the statutory authority under 6.302-1 for a sole source acquisition, citing that no other vendor can provide services using this specific equipment. The embassy did not conduct market research, reasoning that direct purchase from the manufacturer provides the best pricing. The SAM notice will be posted within 14 days after contract award, and the agency acknowledges that barriers to competition could be overcome by potentially changing the existing water filtration systems in the future. The document is certified by William Rhodes (Facility Manager) on 5/21/2024 and Steven Glick (Contracting Officer) on 05/21/2025.

JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN

COMPETITION (OVERSEAS CONTRACTING ACTIVITIES)

1. I recommend that Embassy Baku uses other than full and open competition for the acquisition of filter set and spare parts for the whole house filters. The cost is USD

18,136.98. The procurement request number is PR15348365.

2. Nature and/or description of the action being approved:

Replacement filter set and spare parts for Whole house filters.

3. A description of the supplies or services required to meet the agency’s needs.

Water filtration systems at the U.S. Embassy Baku are compatible only with the spare parts of the B DAVID COMPANY INC.

4. An identification of the statutory authority permitting other than full and open competition.

6.302-1 Only one responsible source and no other supplies or services will satisfy agency requirements.

5. A demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited (for sole source acquisitions; also required for unusual and compelling urgency where more than one offer will not be solicited).

Water filtration systems purchased from B DAVID COMPANY INC are compatible only with the components of B DAVID COMPANY INC.

6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable.

The SAM notice will be posted within 14 days after the contract award.

7. A determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.

The price is fair and reasonable.

8. A description of the market survey conducted and the results or a statement of the reasons a market survey was not conducted.

No market research was conducted because the equipment was procured from B DAVID

COMPANY INC therefore no other vendor can provide the services using this equipment.

Logically, direct purchase from the manufacturer leads to the best price in this case. Any other potential supplier would first need to purchase direct from the manufacturer and then sell to the Embassy with a markup.

9. Any other facts supporting the use of other than full and open competition.

N/A

10. A listing of sources, if any that expressed, in writing, an interest in the acquisition.

N/A

11. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required.

The agency will be able to overcome the barriers to competition if the agency decides to change the existing water filtration systems.
