The Cross-Media Electronic Reporting Rule (CROMERR) published in the Federal Register on October 13, 2005, is the legal framework for electronic reporting under all the EPA’s environmental regulations. EPA Program Offices, States, Tribal, & Local Governments with delegated authority to implement EPA programs, must comply with the CROMERR rules if the data being submitted falls under 40 CFR. Ensuring that EPA & EPA authorized state programs are complying with CROMERR is accomplished by reviewing and approving their applications for the use of CROMERR compliant electronic document receiving systems including signature validation and preservation of a copy of record. The contractor (PPC) supplies critical support to the EPA in reviewing these applications and providing technical advice on how to modify applications not meeting CROMMER standards to ensure that those applications do meet these standards and can be deployed. There are strict deadlines imposed on EPA for completing reviews and then recommending whether the proposed reporting solution of an EPA Program or State delegated Program can be approved as CROMERR compliant. An interruption of service will mean the Agency cannot meet the review deadlines imposed by the regulation. A break in service will also be detrimental to EPA Program & State co-regulators by delaying deployment of new reporting systems, increasing development costs, reducing the ability to provide the regulated community with simpler modes of reporting than paper. It also delays the Agency meeting the government-wide mandate to move to a paperless environment and eliminates the guarantee that the Agency can bring viable enforcement cases against those submitting false reporting information.
6. Government-wide Point of Entry (GPE)/FedBizOps Announcement/Potential Sources:
A notice of intent to issue a sole source award has been publicized to the Government point of entry (GPE) as required by FAR Subpart 5.2.
7. Determination of Fair and Reasonable Cost:
The anticipated cost to the Government is determined to be fair and reasonable by the Contracting Officer for this three (3) month extension. As this is an IDIQ, extending the contract will not result in a direct cost, however, it is anticipated that two (2) task orders under this IDIQ will be extended.
The total Independent Government Cost Estimate (IGCE) amount for these extensions is
. It is anticipated that the labor rates will be the same as the rate of the current extension or at a reasonable market increase (etc). The contractor previously held their labor rates for the six-month extension in accordance with FAR 52.217-8. These rates were deemed to be fair and reasonable at the time of award. The IGCE used the contractor’s option year four monthly burn rates for the TOs and applied a five percent cost of living adjustment to consider current market rates for 2023.
