JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION
DEPARTMENT OF ENERGY/NATIONAL NUCLEAR SECURITY ADMINISTRATION
(DOE/NNSA)
OFFICE OF SECURE TRANSPORTATION (OST)
FEDERAL AGENT MEDICAL DIRECTION, TRAINING AND SUPPORT SERVICES
April 17, 2024 point of injury or illness.
The OST FA Medical Program requires all medical services and support efforts to be consolidated under one contract. OST has learned from experience that dividing the requirements of this contract between multiple vendors is detrimental to a cohesive medical program. Medical training, equipment, and medications must align with protocols derived from Medical Direction. If separated, there would be an excessive amount of coordination necessary to align the objectives of multiple contracts into a unified system.
OST requires specialized training under this contract. The contractor shall provide OST FA Medics specialized basic and advanced hands-on medical training, to enable them to immediately provide lifesaving and/or emergency care to other FAs during a tactical/non-tactical emergency or incident before they are either safely transported to a triage area for further evaluation or medically evacuated to a hospital. The basic and advanced medical training provided under this effort is designed to train new FA Medics as well as validate the skills of current FA Medics by giving them hands-on field training. The contractor shall provide sustainment training to cover treatment for the spectrum of injuries anticipated in an attack against OST. Additional training will be provided to select FA Medics, to expand upon proficiency and skillsets as required to treat trauma anticipated in vehicle accidents and managing illnesses that other FAs experience on duty.
Specialized training includes an initial Emergency Medical Technician (EMT) course which will be tailored to OST’s unique schedule. Upon successful completion and in conjunction with the course, students will sit for the National Registry of Emergency Medical Technicians (NREMT) certification exam before returning to their home station.
OST requires specialized Medical Direction under this contract. The contractor Medical Director shall be a licensed physician, board certified in Emergency Services and Emergency Medicine who will provide medical direction to OST FAs and authorize the medical care which they provide. The contractor Medical Director shall provide written guidance (protocols) that define the mandatory steps for the medical care that OST FA Medics are authorized to perform based upon their training, both with and without online Medical Direction. This will include guidance for authorized formulary and must be updated to reflect changes as they occur.
Under this contract, OST requires specialized Support Services. The contractor shall provide online Medical Direction to OST FA Medics via a 24/7 helpline. The helpline shall be available via a dedicated phone number twenty-four hours per day, seven days per week to provide the OST FA Medic with online Medical Direction for patient treatment in progress. The helpline will be manned by the Medical Director or other well qualified physician who knows the FA scope of practice and has ready access to written FA Medic Protocols.
Additional Support Services include logistics management. The contractor shall obtain and provide medications, medical supplies, and equipment as needed to support the medical program. The contractor shall track expiration dates of medications, medical supplies, and equipment in a database that the FA Medics and Program Manager can access. The contractor shall maintain all necessary licenses and certifications necessary to distribute, prescribe and otherwise manage controlled (scheduled) medications.
IV. AUTHORITY
The statutory authority permitting other than full and open competition is 41 U.S.C 3304(a)(1), as implemented by the Federal Acquisition Regulation (FAR) Subpart 6.302-1 entitled “Only one responsible source and no other supplies or services will satisfy agency requirements.”
Specifically, FAR Subpart 6.302-1(b)(1)(i) Unique supplies or services available from only one source or only one supplier with unique capabilities.
V. APPLICATION OF AUTHORITY
2SRG is the only responsible source with the capability to perform the Performance Work Statement (PWS) scope of work in its entirety. 2SRG has the capability to provide tailored training, medical direction and logistics support services. The individual services may not be unique by themselves; however, the array of services under one business is highly unique.
Training:
Many businesses and educational institutions provide medical training; however, for this requirement medical training must be tailored to the specific discipline and scope of medicine required by OST. The EMT class is the most unique requirement on this contract and OST requires that NREMT testing occur in conjunction with the course.
2SRG conducts three weeks per year of hands-on tactical/civilian trauma training and includes a Field Training Exercise and several Mass-Casualty scenarios utilizing up to 50 live role players. 2SRG also conducts two weeks per year of advanced medical training utilizing cadavers and other state of the art labs. Additionally, 2SRG conducts a four (4)-week state-accredited EMT certification course that is tailored to accommodate OST’s unorthodox schedule and personnel. No other organizations have been found which can meet the EMT course requirements as outlined in the PWS. Also, 2SRG serves as the training center for NREMT/American Safety & Health Institute (ASHI) which is important to maintain EMT/Cardiopulmonary Resuscitation (CPR) certifications for all OST medical personnel.
Medical Direction:
Many businesses provide medical direction services, however the integration of these services into a comprehensive and cohesive medical program is one unique aspect of this requirement.
The second unique aspect of this requirement is the combination of medical direction with all other requirements, for example, the training required by OST and defined under the PWS.
Separate entities providing training and medical direction adds complexity since there can be a delta between the tools, techniques, and procedures taught by one company and what is allowable by the Medical Director.
2SRG has the unique capability to provide online and offline Medical Direction services as required by OST. 2SRG will provide a Medical Director that is board-certified in Emergency Medical Services and will provide overall control of the OST medical program. Online medical control would be provided via 2SRG’s medical control hotline which utilizes the Medical Director and 2 other board-certified physicians, rotating duties to ensure 24/7/365 coverage.
The hotline has a redundant call-forwarding system to ensure all calls are answered. Offline medical control will be provided via 83 medical protocols, which will be updated annually in conjunction with OST medic recertification courses. No other vendor demonstrated this unique capability.
Support Services:
Of the additional support services required by OST, medical logistics support is the most unique in terms of complexity and integration. There are many medical supply distributors however, it is the integration of those services into a cohesive medical program that provides a unique value to OST.
2SRG has the capability to support the full spectrum of OST medical logistics. 2SRG utilizes a database that contains equipment and medication management resources to track inventories of operational medical bags and controlled medication kits. 2SRG has the capability to source and order 100+ line numbers of medical equipment/supplies based on tracked expiration dates and usage. 2SRG has the capability to sort and label equipment and supplies based on each specific medical bag they need to resupply and ship directly to the OST Units. 2SRG can supply medications based on usage and tracked expiration dates, coordinating shipping and reverse-distributing expired medications. They have the capability to provide logistics support to 3 geographically separated locations. 2SRG maintains required Drug Enforcement Administration (DEA) licenses necessary to manage controlled medications in New Mexico, Texas, and Tennessee.
Based on the above and given the OST’s unique national security mission, 2SRG has been determined by NNSA to be the only source with the unique capability to meet the Federal Agent Medical Direction, Training and Support Services Performance Work Statement (PWS) requirements.
VI. EFFORTS TO IDENTIFY ADDITIONAL SOURCES
Pursuant to FAR Part 10, a Sources Sought Notice (SSN) No. 89233123NNA000107 and Draft Performance Work Statement were released on June 8, 2023 through FedConnect and SAM.gov with a closing date of July 13, 2023 under NAICS Code 621999 (All Other Miscellaneous Ambulatory Health Care Services) and with the intent of identifying small business set-aside possibilities.
Additional market research consisted of a review of relevant historical data and the use of internet tools to perform online searches of known sources in the medical training community as well as identifying new sources. Also, in accordance with FAR 5.203, a notice of intent (NOI) to sole source this procurement was released on March 13, 2024 through FedConnect and SAM.gov under Reference Number 89233124NNA000126 with the closing date of March 29, 2024. In the notification of intent, all responsible sources that believe that they can perform the requirements were asked to submit a capability statement demonstrating in detail the ability to perform the requirements and advised that any information received from interested sources will only be considered solely for the purposes of determining whether to conduct a competitive procurement.
vendors inclusive of 2SRG responded to the SSN and vendor responded to the NOI to Sole Source. OST determined that of the vendors who submitted Statement of Capabilities, 2SRG was the only vendor capable of performing the scope of work in its entirety (See summary table below).
