JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION (JOFOC)

RESIDENTIAL REENTRY CENTER (RRC)

CONTRACT #15BRRC20D00000316

LOCATED WITHIN EVANSVILLE, IN

1. Agency:

The United States Department of Justice, Federal Bureau of

Prisons (Bureau), Administration Division, Acquisitions

Branch, Residential Reentry Contracting Section.

2. Description of Action Being Approved:

Pursuant to the Federal Acquisition Regulation (FAR) Part

6.302-2(b)(1) and (2), the Bureau has determined the need for

RRC services located in Evansville, Indiana (Evansville) meets the criteria established for other than full and open competition. This limitation of competition is justified in accordance with FAR Subpart 6.303-2, Content.

Based on the information provided in this justification, a three month contract will be awarded to Volunteers of America of Indiana, Incorporated (VOA), under other than full and open competition procedures, for continued RRC services for federal offenders located in Evansville.

3. Description of the Services Required to Meet the Agency Needs:

RRC services located in Evansville for the period

July 1, 2020 through September 30, 2020.

A new contract numbered 15BRRC20D00000296 with an estimated maximum amount of $510,048.00($99.00 per day for in-house services x 4,600 inmate days = $ 455,400.00 and $49.50 per day for home confinement services x 1,104 inmate days =

$54,648.00) will be issued to VOA.

4. Statutory Authority Permitting Other than Full and Open

Competition:

Other than full and open competition is based on the authority of 41 U.S.C. 3304(a)(2) as implemented by FAR 6.302-2, Unusual and Compelling Urgency.

5. Determination that proposed Contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited:

Contract 15BRRC20D00000296 requires services for a maximum of

40 male offenders and 10 female offenders. The current contract will expire on June 30, 2020.

The replacement solicitation, Request for Proposals (RFP)

15BRRC19R00000112, was issued for services in Evansville and one proposal was received. In total, the Bureau has conducted four rounds of discussions and a final proposal revision. A n award was expected to be made on the premise that the pr e occupancy inspection would be waived until the Ful l

Monitoring. In preparing the award documents, it wa s determined that the safety inspection recommended that th e

Residential Reentry Safety Specialist (RRSS) inspect th e facility before performance. During the inspection, the RRSS found a life safety deficiency in that there were walls tha t did not go all the way to the ceiling which affects the fir e rating. Due to the life safety deficiency, a pre-occupanc y inspection must be performed before proceeding with contrac t award. The award of Contract 15BRRC20D00000316 will allow for continuity of services while the contractor prepares th e facility for operational availability and the Bureau completes the administrative functions required to ensure compliance with the contract requirements.

Contract 15BRRC20D00000296 will expire on June 30, 2020. The

Bureau has determined that a new contract will be awarded for three months until September 30, 2020 due to the need of services.

From a technical standpoint, VOA is currently providing the services required by the Bureau. The Residential Reentry

Manager’s Office and the RRMB determined that VOA coul d provide the required services at the required quantity in

Evansville by the performance start date of July 1, 2020. The

Contracting Officer reviewed all of the documentation an d agreed. VOA is able to continue providing services with out risk to the community and to the Bureau on July 1, 2020 .

The closest facilities under contract with the Bureau are in

Michigan City, IN; Toledo, OH; Cincinnati, OH; and, Cleveland, OH which are located approximately 218 miles to 466 mile s away. Based on the RRC utilization report, these facility es will not have available bed space to house the projecte d number of 50 additional offenders.

The services required are of an unusual and compelling urgency due to the Bureau’s essential need. If services cannot be provided at this location, the Bureau has two options:

transfer offenders to another RRC to continue receiving services or return the offenders to a secure institution.

The mission of the reentry program is to assist federal offenders during the transition from prison to the community by providing services which include self-improvement opportunities as well as assistance to secure employment and locate a permanent residence after their program is complete.

Offenders are typically assigned to a RRC near the location where they will eventually be released. The Bureau contracts with these RRCs to provide assistance to inmates who are nearing release from federal custody. RRC placements provide a safe, structured, supervised environment in the individual’s community, as well as assistance, drug treatment, and other reentry programs and services. RRCs help inmates gradually rebuild their ties to the community and supervise their activities during this community readjustment period.

Therefore, transferring the offenders to another facility or returning the offenders to a secure institution for the three-month period requested in this justification would cause serious harm to the mission of the Bureau and would be a disruption to the inmate’s reentry programming. Offenders transferred to another facility may be unable to search for suitable housing or employment and/or face a loss of employment due to lack of transportation. Relocating offenders does not support the overall mission of the Reentry

Services Division or the Bureau in the attempt to re-integrate the offenders into society as law abiding citizens.

6. Efforts made to solicit from as many sources as practicable, including whether or not a notice was published in the GPE:

Based on the urgent requirements of these services, the exception at FAR 5.202(a)(2), applies therefore a notice was not published in the Government Point of Entry (GPE). Th e impending end of Contract 15BRRC20D00000296 on June 30, 2020, does not provide adequate time to issue Requests for Proposals and adequately evaluate each proposal received.

7. Contracting Officer’s determination that cost to the

Government will be fair and reasonable:

The Contracting Officer has determined that the anticipated price to the Government will be fair and reasonable based on a comparison of current Government contract prices for RRC services.

RRC Services:

Michigan City, In - $ 101.64/inmate day-Apprx.

(DJB200277) 7/1/19 – 6/30/20 (Option Year Three)

Cleveland, OH - $ 89.45/inmate day-Apprx.

(DJB200294) 10/1/19 – 9/30/20 (Option Year Three)

8. Description of the market survey conducted:

In conducting Market Research for this justification, the

Contracting Officer noted that VOA submitted the only response to the solicitation resulting in Contract DJB200213, which is a five year contract and submitted the only proposal in response to RFP 15BRRC19R00000112. As the incumbent, VOA is the only contractor that has the proper zoning, personnel, and facility that would satisfy the Bureau’s requirement for RR C services in the time period needed to ensure there is no lapse in services.

9. Other facts supporting the use of other than full and open competition:

N/A

10. List of sources, expressing in writing, interest in the acquisition:

VOA provided an e-mail expressing interest to continue providing RRC services. VOA agreed to provide RRC services during the extended performance period at the inmate rate of

$99.00 per day for RRC services and $49.50 per day for Home

Confinement services.

11. Actions taken by the agency to remove or overcome barriers to competition:

It currently takes the Bureau approximately 18 months to award a RRC contract; therefore, there is no time to solicit for services for such a short period of time.

I certify that the justification is accurate and complete to the best of the Contracting Officer’s knowledge and belief.
