About this file

This document is a Justification for Other Than Full and Open Competition (JOFOC) for an emergency sole source procurement of grease trap pumping services at the Federal Correctional Complex (FCC) in Yazoo City, Mississippi.

The agency, the Federal Bureau of Prisons (BOP), determined that Mid-South Septic Services, LLC is the only responsible source within the local geographic area that can provide the required grease trap pumping services and equipment to address an urgent and compelling need. FCC Yazoo City has an immediate requirement to pump the grease traps at the entire complex to prevent major backups and unsanitary conditions in the food service areas. Due to the rural location of the facility, Mid-South Septic Services is the sole provider with the necessary specialized equipment and capabilities to perform this work in a timely manner. The estimated cost for this sole source award is $94,230. The Contracting Officer determined the pricing is fair and reasonable. The BOP will post a Special Notice on SAM.gov to negotiate this sole source contract with Mid-South Septic Services as no other sources were identified that could meet the urgent need.

10. List of sources expressing in writing interest in the acquisition:

Due to the unique requirement of this EMERGENCY acquisition, there were no other sources contacted due to an immediate need for services.

11. Action taken, if any, to remove or overcome any barriers to competition:

The Contracting Officer has determined that this type of Emergency procurement is rare and/or limited due to Mid-South Septic Services, LLC. being the only responsible source that provides grease trap pumping services. They are located within this geographic area and have a valid Unique Entity ID in SAM.gov. They can provide the services and proper equipment to pump the entire complex. Mid-South Septic Services, LLC is the only contractor at this imminent time who can handle the mass buildup in the grease traps.

FCC Yazoo City is located in a rural location which makes it difficult to find responsible vendor within the geographical location to provide services for this type of requirement.

Market research will continue to be conducted to ascertain the availability of other sources for competition for future acquisitions.
