About this file

This is a Justification and Approval (J&A) document for other than full and open competition due to unusual and compelling urgency at the James H. Quillen VA Medical Center in Mountain Home, TN. The document justifies sole-source award to Taylor Construction Services, LLC for emergency repairs to hurricane-damaged soffits on Building 160.

The scope includes removal and replacement of approximately 3,500 square feet of damaged aluminum linear soffit system and hat channels on the South/Southwest face of Building 160, caused by Hurricane Helene. The contractor will install new heavier gauge structural steel hat channels and a Rockfon Planar Linear Panel System to match existing components. The period of performance is 120 calendar days from Notice to Proceed, with an estimated cost of $1,040,000. The VA is using FAR 6.302-2 (Unusual and Compelling Urgency) as the authority, citing immediate safety concerns from dangling components 75 feet above grade and potential catastrophic roof failure that could make the building uninhabitable. The building houses critical hospital functions including domiciliary patients, mental health clinic, primary care, and the main kitchen.

DEPARTMENT OF VETERANS AFFAIRS

Justification and Approval (J&A) For

Other Than Full and Open Competition (>SAT)

Acquisition Plan Action ID: 36C249-25-AP-0217

1. Contracting Activity: Department of Veterans Affairs, VISN 9, Network Contracting Office (NCO) 9, James H. Quillen VA Medical Center (Mountain Home), 2237 #-621-25-1- 5117-0001.

2. Nature and/or Description of the Action Being Processed: Mountain Home has an urgent need to repair hurricane damage to soffits and replace affected components. Recent storms and high winds brought about by Hurricane Helene severely damaged a large portion of the building 160 soffit located on the South/Southwest face of the building. It is recommended that all the linear soffits and backing hat channel in the damaged areas are removed and replaced with new to match existing. Removal and replacement of existing hat channels with heavier gauge equivalent size hat channel, with reduced spacing, and new hat channel screws are required. This should address future wind loading needs and extend the useful life of this building system.

Mountain Home is proposing a new, Firm Fixed Price (FFP) contract be awarded to Taylor Construction Services, LLC for the emergency repair to soffits and affected components.

3. : The scope of work for project # 621-25-102 consists of providing all equipment, materials, labor, superintendence, safety, quality control, and administrative oversite to perform work safely and promptly for VA Project # 621-25-102 Emergency Repair Building 160 Soffit at the James H. ( ) (7) Public Interest per 41 USC §3304(a)(7) as implemented by FAR 6.302-7;

5.

Acquisition Requires the Use of the Authority Cited Above (applicability of authority):

Due to Hurricane Helene, one half to two thirds of th soffit area was ripped away from its roof supports. Material has fallen away from the building s structure, landing on lower roofs, and or blown into adjacent parking lots and roads. Upon investigation by the facilit s engineering office, the remainder of the South/Southwest soffit areas showed similar failure. It has been determined that aluminum linear soffit system screws have pulled out of the metal hat channel backing supports used to attach the building soffits to the structure.

The nearby area has undergone many changes including a two-phased construction of a 4-story parking structure to the southwest of building 160. Due to the orientation of building 160, the normal northeast wind patterns, and the new parking structure, it is likely this combination that has created a wind tunnel effect that has placed sustained wind loading in excess of the building original design and as a result the soffits only on the Southwest/Southeast faces of building 160 have shown this damage.

Failure to correct this issue could subject the main roof structure to uplift forces from the wind that are above design limits. This could lead to catastrophic failure of the main roof system and make the entire building uninhabitable. This building houses the domiciliary patients, mental health clinic, primary care, and the main kitchen for the hospital. If we were to lose this building all of these functions would be lost.

This procurement action is classified as an EMERGENCY due to the fact that existing soffit system component are dangling from the structure more than 75 feet above the surrounding grade and many other areas in this location are showing similar signs of failure. These conditions are a major safety issue and could lead to lose of life or property.

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: Taylor Construction Services (TCS) is the only source being solicited at this time due to the unusual and compelling urgency of this specific requirement. All routine non-emergency requirements are and will continue to be publicized and competed amongst SDVOSB entities.

7. Determination by the Contracting Officer (CO) that the Anticipated Cost to the Government will be Fair and Reasonable: Only one source is being solicited due to the unusual and compelling urgency of this requirement. The CO anticipates determining the price to be fair and reasonable based on a comparison to previous award prices for similar projects (listed below) which were determined fair and reasonable either by competition or comparison to Independent Government Cost Estimate (IGCE). The IGCE for this requirement is $1,040,000.00.

8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: Due to the unusual and compelling urgency of this requirement, the proposed source for this action is TCS. Taylor meets the eligibility criteria outlined in VAAR 819.7003(DEVIATION), is active in sam.gov and VetCert, and is represented as small for the applicable NAICS code, 238170-Siding Contractors with a small business size standard of $19M. No further market research was conducted because Taylor was found responsible and is a SDVOSB. TCS is located approximately 20 miles from the Mtn Home VAMC. The Contracting O Representative and CO are familiar with TCS and know they are reputable and have a good work record.

9. Any Other Facts Supporting the Use of Other than Full and Open Competition: None.

10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: Not applicable.

11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: Market Research was conducted on the VetBiz database and the Dynamic Small Business Search (DSBS) for all SDVOSB entities in Tennessee and its bordering states. For NAICS 238170-Siding Contractors, VetBiz revealed 59 SDVOSB entities and DSBS revealed 153 SDVOSB entities. But, due to the nature of this requirement, and staff, this procurement needs to be procured as a sole source emergency requirement. By awarding as quickly as possible, the hurricane damage can be repaired and replaced, whereby preventing injury to persons or further damage to the facility. The initial market research conducted for this requirement can be utilized for future competition for similar future acquisitions if they arise.
