JUSTIFICATION AND APPROVAL
FOR OTHER THAN FULL AND OPEN COMPETITION
ACQUISITION OF LOCAL PHYSICIAN SERVICES AT U.S. EMBASSY TALLINN
1. I recommend that EmbassyTallinn use other than full and open competition for the acquisition of primary care medical services. The estimated cost is ( 144,000.00 ($ 165,000.00).
2. Nature and/or description of the action being approved.
Follow- on Contract for primary care services at the Embassy building
3. A description of the supplies or services required to meet the agency's needs.
Valvekliinik OU Parnu mnt. 48A Tallinn. Estonia
The contract is for following services:
• Contractor shall have patient appointments twice per week, totaling 4 hours per week
• During scheduled hours evaluates direct hire and other eligible Embassy community members that are under the Chief of Mission; determines and recommends the appropriate medical treatment for medical conditions ranging from minor complaints to serious emergency illnesses or injuries requiring case management or hospitalization and/or medical evaluation; consults on complex cases and medical evacuation.
• Contractor shall be in charge of maintaining and updating patient records that are kept at the Embassy
• Contractor shall accept phone calls during the days they are not at the Embassy from Embassy employees and eligible family members.
• All materials and supplies as needed shall be provided by the Embassy.
• The Contractor shall issue prescriptions to patients as needed. The prescriptions shall be for chronical illnesses and/or acute medical problems
• Additional services will be on an as needed basis, mostly when the Embassy Nurse is on holiday, away or on sick leave. Additional services will be mostly phone coverage in case of an emergency.
4. An identification of the statutory authority permitting other than full and open competition.
Only One Responsible Source: Meets the criteria of being fluent in both English and Estonian, has good contacts and is very familiar with Estonian health care system, respects Regional Medical Officer's treatment decisions, and has very good bedside manner based on U.S. expectations of physician-patient care.
Unusual and compelling urgency: The health care system in Estonia is under strain given the steady and continuous rise of COVID-19 cases. There is a shortage of family physicians in Estonia and clinics are being overrun at the moment with suspected cases. Post cannot wait until an undefined date to solicit the contract as it cannot afford to go without continuous local medical coverage. A gap in coverage would put the lives of U.S. direct-hires and eligible family members at risk since many at post do not speak Estonian and cannot navigate the health care system without a local physician who is fluent in Estonian and English and has the capacity to treat members of post.
5. A demonstration that the proposed contractor's unique qualifications or the nature of the acquisition requires use of the authority cited.
U.S.Embassy Tallinn has been unsuccessful in previous years in securing contract from any other local vendor capable of providing the same level of medical services or meeting the essential requirements (mentioned in section 4).
6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable. The description should include whether a FedBizOpps notice was or will be publicized, as required by FARS.2, and if not, which exception under FAR5.202 applies (e.g., revised blanket waiver referenced in PIS2016-10).
Due to Urgency and only one responsible source being available the solicitation cannot be posted but the JOFOCwill be publicized as required by FARS.2.
7. A determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.
USEmbassyTallinn determined based on there being no market in Estonia for this kind of service delivery, that the price offered is fair and reasonable to the government.
8. A description of the market survey conducted and the results or a statement of the reasons a market survey was not conducted.
Market survey based on two prior solicitations and vendor feedback about services requested.
9. Any other facts supporting the use of other than full and open competition.
None
10. A listing of sources, if any that expressed, in writing, an interest in the acquisition.
Multiple e- mails and visits to other private clinics in past, which showed a lack of technically qualified alternatives. The biggest issue seems to be not being fluent in English and the questioning of RMO's treatment decisions.
11. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required.
