JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION
Pursuant to the Federal Acquisition Regulation (FAR) Subpart 6.302and the Bureau of Prisons Acquisition Policy (BPAP) Part
6.304 and the Federal Bureau of Prisons (BOP) the United States Penitentiary, located in Jonesville, Virginia has determined that limited competition for the fees to dump trash at the Lee County Transfer station meets the criteria established for other than full and open competition. The following is a list of supporting documentation in accordance with FAR subpart 6.303- 2(a).
1. IDENTIFICATION OR THE AGENCY AND THE CONTRACTING ACTIVITY:
Department of Justice Federal Bureau of Prisons United States Penitentiary Hickory Flats Road Jonesville, VA 24263
2. NATURE AND/OR DESCRIPTION OF ACTION BEING APPROVED:
Facilities Management and Maintenace is required to provide proper removal of onsite trash. It is requirement that non-recyclable trash be removed in a timely manner due to security and safety concerns. To allow for this process, the institutional trash is removed by the FBOP and hauled to the local solid trash transfer station. This process incurs transfer station fees through County of Lee (Lee County Board of Supervisors), and the Lee County Transfer Station.
3. DESCRIPTION OF SUPPLIES AND SERVICES REQUIRED TO MEET THE
AGENCY NEEDS (INCLUDING ESTIMATED VALUES):
The total estimate of fees for October - September is $40,000.00 to meet and satisfy this obligation.
4. IDENTIFICATION OF STATUTORY AUTHORITY PERMITTING OTHER THAN
FULL AND OPEN COMPETITION:
This justification and approval is being submitted for approval in accordance with 41 U.S.C. Sec. 253 (c) (1) and FAR 6.302-1, “Only one responsible source and no other supplies or services will satisfy agency requirements.”
5. DETERMINATION THAT PROPOSED CONTRACTOR’S UNIQUE
QUALIFICATIONS OR THE NATURE OF THE ACQUISITION REQUIRES
USE OF THE AUTHORITY CITED:
The Lee County Transfer Station is the only trash station in Lee County. Due to county governmental laws, other cities and counties cannot take Lee County solid waste.
6. EFFORTS TO ENSURE THAT OFFERS ARE SOLICITED FROM AS MANY
POTENTIAL SOURCES AS PRACTICAL:
Due to county governmental laws, the only trash station we are authorized to use is the Lee County Transfer Station, which is billed by the Lee County Board of Supervisors.
7. DETERMINATION THAT THE ANTICIPATED COST TO THE GOVERNMENT
WILL BE FAIR AND REASONABLE:
The Contracting Officer anticipates the cost to the Government will be fair and reasonable.
8. DESCRIPTION OF MARKET RESEARCH:
Market research was conducted via the internet and telephone. Market research revealed there is only one source for these services. Market research further revealed the costs being charged to the Government is the same as costs charged to other county businesses and residents.
9. OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND OPEN
COMPETITION:
Due to state and/or county laws and regulations, the disposal of garbage is required to be done in the affected county.
10. SOURCES THAT EXPRESSED, IN WRITING, AN INTEREST IN THE
ACQUISITION:
