4. Statutory Authority Permitting Restricted Competition:
FAR 13.5 Simplified Procedures for Certain Commercial Items. The statutory authority for applying the Simplified Procedures for Commercial Items of FAR 13.5 is 41 U.S.C. § 1901 and is implemented by FAR 13.106-1(b)(2) for restricting competition on this procurement. Competition is restricted on this procurement for the reason below:
(X) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements
( ) Unusual and Compelling Urgency ( ) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert
Services ( ) International Agreement ( ) Authorized or Required by Statute ( ) National Security ( ) Public Interest
5.
the Use of the Authority Cited Above (applicability of authority): As the manufacturer of this software, Abbott Rapid Diagnostics Informatics Inc (RALS) is the only authorized supplier of these software licenses. No one else manufactures, sells or supports (e.g., provides software updates for) this software.
If another vendor were awarded a contract for these services, it would require a full changeover of all existing RALS (Laboratory Point of Care middleware) software. This would be an undue burden on VA in terms of required costs to replace the software and workload to stand up a new system.
Additionally, VA would need to contract with Cerner to retest all existing POC interfaces currently connected from the VA to Cerner via RALS.
6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: Sources Sought 36C26022Q0528 was posted to beta.SAM from 05/25/2022 06/09/2022 resulted in zero positive results from vendors of any size demographics. At the conclusion of the sources sought, it was decided to exercise the option to extend the current contract 36C26021P0855 for six months, to give adequate time for the current request to be reviewed and approved.
7. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable: IAW FAR 13.106-3(a)(2)(vi) the anticipated cost will be considered fair and reasonable by analyzing the final contract price against the Independent Government Cost Estimate. The final contract price will be compared against similar contracts that were published in the Federal Procurement Data System (FPDS).
