About this file
This justification and approval document and related federal contract opportunity outline upgrades to existing explosive ordnance disposal robots utilized by the United States Secret Service. The Department of Homeland Security awarded a sole source, firm-fixed-price contract valued at an undisclosed amount to an unknown vendor on September 27, 2022. The contract requires refurbishing and upgrading three Remotec F6 series robots owned by the Secret Service to the newer Remotec Spartan robot platform. Work will be completed as the robots are transferred from the Secret Service to the contractor and will not all be worked on simultaneously. The justification cites 41 U.S.C. 3304(a)(1) and 6.302-1 of the FAR as the authority permitting other than full and open competition due to the contractor being the only responsible source and no other supplies or services satisfying the agency's requirements.

J&A No: Page 2 of 3
03.21.2022 v.1.0
Justification and Approval (J&A) for Other Than Full and Open Competition Template based on DHS OCPO J&A Guide Version 3.3
a. Refurbish and upgrade the following three USSS owned F6 robots to Spartan robots:
1. Remotec F6A - Serial Number F544302N00803;
2. Remotec F6A, Serial Number F54430IN00803; and
3. Remotec F6B, Serial Number FB17232-01N000213
b. To maintain operational capability, all robots will not be worked on at the same time. Work to be completed as outlined in the SOW will be done as robots are transferred from USSS to Remotec.
4. Identification of statutory authority permitting other than full and open competition.
The statutory authority permitting other than full and open competition is 41 U.S.C.3304(a)(1), implemented by the FAR Subpart 6.302-1 entitled “Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.”.
5. Identification of exception to the Buy American Statute. The Buy American Act does not apply to this requirement.
6. Demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited.
The equipment and services provided under this requirement are proprietary in nature. Currently, Remotec/Peraton does not allow other third-party vendors to provide equipment or services as they hold the patent. To utilize another vendor would require the USSS to procure new equipment that would cost several million dollars and would inhibit the protective mission by extensive time for building, testing and delivery of new robots. Awarding to Remotec/Peraton reduces costs, time and will not create any issues with maintaining the USSS protective mission.
7. Description of efforts made to ensure that offers are solicited from as many potential sources as is practicable.
Market research was conducted to determine if there was new information available to support a competitive procurement. The manufacturer does not have authorized resellers of equipment or maintenance. The market research report was completed and submitted to document the results.
8. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.
The contracting officer determines that the anticipated price(s) will be fair and reasonable based on the I E and commercial pricelist offered by Remotec/Peraton.
