JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION
RESIDENTIAL REENTRY CENTER (RRC) SERVICES
CONTRACT 15BRRC21D00000334
Located within Tampa, Florida
1. Agency:
The United States Department of Justice, Bureau of Prisons (Bureau), Administration Division, Acquisitions Branch, Residential Reentry Contracting Section.
2. Description of Action Being Approved:
Pursuant to the Federal Acquisition Regulation (FAR) Part 6.302-2(b)(1) and (2), the Bureau has determined the need for RRC Services located in Tampa, Florida, meets the criteria established for other than full and open competition. This limitation of competition is justified in accordance with FAR 6.303-2, Content.
The action to be approved is a four-month extension of the contract to Goodwill Industries-Suncoast, Inc. (Goodwill), under other than full and open competition procedures for continued RRC services for Federal offenders located in Tampa, Florida.
3. Description of the Services Required to Meet the Agency Needs:
Services required are RRC services located in Tampa, Florida, for the period of May 1, 2021 through August 31, 2021.
Contract 15BRRC21D00000334 for an estimated amount of $850,022.25 will be issued to Goodwill.
4. Statutory Authority Permitting Other than Full and Open Competition:
Other than full and open competition is based on the authority of 41 U.S.C. 3304(a)(2) as implemented by FAR 6.302-2, Unusual and Compelling Urgency.
5. Determination that proposed Contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited:
The facility located in Tampa, Florida, currently houses 62 male and 15 female federal offenders. The current contract will expire on April 30, 2021.
On November 24, 2020, the Bureau awarded a new contract 15BRRC21D00000260, to GEO Reentry, Inc., located within the area of Tampa, Hillsborough County, Florida. GEO has a 120-days compliance period to ensure its proposed facility is fully operational. Their proposed facility will require the construction of modular buildings.
On January 8, 2021, GEO requested to change the start of performance date from April 1, 2021 to September 1, 2021.
According to GEO, they are experiencing delays with the development of the proposed facility due to impacts related to the COVID 19 pandemic. Their contractor (Balfour Beatty Construction Company) has experienced delays from their material supply chain due to the COVID-19. GEO has provided an updated schedule with a completion date of September 1, 2021.
The unanticipated delays caused by COVID-19 were beyond GEO’s control. The material shortages and significant delays in lead time as a result in the labor force contracting the virus at the modular factory, causing periodic shutdowns. The modular building is increasing the duration to complete manufacturing.
According to GEO, in acquiring permits, the process has changed the process of acquiring permits, which added several months to the permitting process.
On March 8, 2021, a modification was issued to contract 15BRRC21D00000260 to change the performance period from April 1, 2021 to September 1, 2021.
This bridge contract 15BRRC21D00000334 to Goodwill will allow for continuity of services while GEO prepares the facility for operational availability.
From a technical standpoint, Goodwill is currently providing the services required by the Bureau. The closest facilities with contracts with the Bureau will not have available bed space. The Orlando Residential Reentry Manager’s Office and Residential Reentry Management Branch (RRMB) have determined that Goodwill could provide the required services at the required quantity by the performance start date of May 1, 2021.
The Contracting Officer has reviewed all of the documentation and agrees that Goodwill will be able to continue providing services without risk to the community and to the Bureau by May 1, 2021.
The services required are of an unusual and compelling urgency due to the Bureau’s essential need. If services cannot be provided at this location, the Bureau has two options: Transfer offenders to another RRC to continue receiving services or return the offenders to a secure institution.
The closest RRC facility under contract with the Bureau is located in Orlando, Florida. Based on the RRC utilization, this facility will not have available bed space to house the additional 77 offenders.
The mission of the reentry program is to assist federal offenders during the transition from prison to the community by providing services that include self-improvement opportunities as well as assistance to secure employment and locate a permanent residence after their program is complete.
Offenders are typically assigned to an RRC near the location where they will eventually be released. The Bureau contracts with these RRCs to provide assistance to inmates who are nearing release from federal custody. RRC placements provide a safe, structured, supervised environment in the individual's community, as well as assistance, drug treatment, and other reentry programs and services.
RRCs help inmates gradually rebuild their ties to the community and supervise their activities during this community readjustment period. Therefore, returning the offenders to a secure institution for the period requested in this justification would cause serious harm to the mission of the Bureau and would be a disruption to the inmate’s reentry programming. Relocating the offenders does not support the overall mission of the Reentry Services Division or the Bureau
9. Other facts supporting the use of other than full and open competition:
N/A
10. List of sources, expressing in writing, interest in the acquisition:
Goodwill provided an e-mail expressing an interest to continue providing RRC services through August 31, 2021. Also, Goodwill agreed to provide RRC services at the same inmate day rate as the current contract.
11. Actions taken by the agency to remove or overcome barriers to competition:
It currently takes the Bureau approximately 18 months to award an RRC contract; therefore, there was no time to solicit for services for such a short period of time. The performance period of the new contract 15BRRC21D00000260 awarded to GEO located within the area of Tampa, Hillsborough County, Florida, will start on September 1, 2021.
This justification is for a bridge contract to extend the existing contract beyond the period of performance until performance begins on the competitively awarded contract.
12. Contracting Officer’s Certification:
I certify that the justification is accurate and complete to the best of the Contracting Officer’s knowledge and belief.
