JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION IN ACCORDANCE WITH (STATE AUTHORITY E.G., 10
U.S.C. 2304 (C)(1) OR 41 USC 253)

1. Identification of the agency and contracting activity.
The U.S. Department of Justice, Federal Bureau of Investigation (FBI), National Acquisition Programs Unit (NAPU), has prepared this justification for other than full and open competition for the procurement of Cuattro, LLC. brand EOD systems on behalf of the Counter IED Section (CIEDS), Critical Incidence Response Group (CIRG).
2. The nature and/or description of the action being approved, i.e., sole source, limited competition, establishment of a new source, etc.
The proposed action is to acquire seven (7) Cuattro brand EOD systems and associated components. This procurement will be advertised on the SAM.gov website as a brand name only, open market requirement. Authorized resellers of Cuattro, LLC products will be encouraged to submit a competitive quotation. The resultant contract is intended to be awarded as a one-time, firm-fixed price, purchase order.
3. A description of the supplies or services required to meet the agency’s needs.
To support CIRG’s mission CIEDS requires a portable system to take Digital Radiography on a hostage or potential explosive device. Specific requirements are for Cuattro EOD System with an “IP67” rated panel. The units will provide a Digital Radiography without going back into a hazardous area. The Cuattro is designed to allow an X-ray to be taken remotely and the Digital Radiography viewed on the control computer. This Radiography system is light and portable which will reduce the time for FBI personnel to clear an item.
4. The statutory authority permitting other than full and open competition.

The statutory authority permitting other than full and open competition is 41 U.S.C.3304 (c)(1) as implemented by the Federal Acquisition Regulation (FAR) Subpart 6.302-1 entitled, “Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.” – Application for Brand Name.
5. Demonstrate the unique qualifications of the proposed contractor or the nature of the action requiring the use of the authority.
The Cuattro EOD Systems are integrated into the Tactical Special Agent Bomb Technicians’ (TSABT) tool kit, which is identical across the FBI Tactical Teams. All TSABTs will be trained with this device so continuity is an important factor. Members of the TSABT do not have time to learn how to use a new device while operating on an explosive or Improvised Explosive Device (IED).
The Cuattro EOD System is currently in use by the FBI and is the only available unit of its kind that is production ready. Additionally, the U.S. Military’s Render Safe teams, CIEDU’s Render Safe teams, and the FBI’s Hazardous Devices Response Unit currently use the Cuattro EOD System.
This unit is being purchased to provide the same equipment for training purposes at the Hazardous Devices School which trains FBI, State, and Local bomb technicians. The Cuattro EOD Systems will ensure compatibility with the standardized equipment and associated protocols currently in use.
A technical evaluation of various Digital Radiography panels was conducted by the Render Safe Unit (RSU), as well as the Tactical Special Agent Bomb Technicians (TSABT). The documentation clearly justifies that the performance of the Cuattro System far exceeded the other vendor’s products. In addition, the cost of the Cuattro system is about twenty-five percent less than the other vendors evaluated. Overall, the Cuattro EOD system performed flawlessly. The difference between Cuattro and other panels brought to the assessment was significant.
It was recommended by many professionals that the Cuattro EOD System be purchased for its performance, reliability, and cost. The Cuattro EOD system clearly and decisively outperformed the other panels reviewed during this assessment.
6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies.
This requirement will be posted on the beta.SAM.gov website, as a brand name only, open market requirement. This announcement will give an opportunity for authorized resellers of Cuattro brand products to demonstrate their ability to meet the FBI’s specific needs through a submission their technical capabilities and cost information.
7. The anticipated dollar value of the proposed acquisition, including options if applicable, and a determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.

The anticipated dollar value of this award shall not exceed $XXX,XXX.XX. Prior to issuing an award, the Contracting Officer will determine that the proposed price is fair and reasonable in accordance with FAR 13.106-3.
8. A description of the market research conducted and the results.
Market research was conducted through internet searches, demonstrations by vendors and through Government databases of vendors providing portable x-ray devices. Several CIRG/CIEDS units combined and conducted a three-day assessment and evaluation of several top Digital Radiography vendors as well as conducted peer evaluations of various systems. The resulting determination is that the Cuattro EOD System far exceeded other vendor’s products and meets CIRG’s requirements for the following reasons:
X-ray panel is 10”x12”, roughly the size of a tablet computer Remote control capability High resolution images Integrated to run on a personal computer using the Microsoft Windows OS Works well with XTK Software.
Twenty-five percent cheaper than the other products demonstrated
Market research determined that there is at least one authorized reseller of the Cuattro brand EOD System. CIRG will continue to conduct strategic market research on portable x-ray devices.
As part of their standard operating procedures, CIRG will incorporate lessons learned from training and actual operations on the performance in relation to their tactics, techniques and procedures.
9. Any other facts supporting the use of other than full and open competition.
Please see section five (5) above.
10. A listing of any sources that expressed a written interest in the acquisition.

This announcement will give an opportunity for authorized resellers of Cuattro products to demonstrate their ability to meet the FBI’s specific needs through a submission their technical capabilities and cost information.
11. A statement of any actions the agency may take to remove or overcome any barriers to competition, if subsequent acquisitions are anticipated.
The actions of the CIRG to identify potential sources possessing the ability to satisfy this and similar requirements are ongoing. The FBI will continually search the market in an effort to find viable competitors for this requirement in the future. Over time, additional sources may become
