JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION
(JOFOC)
For Range Operations Contract II (ROC-II), Contract 80GSFC19C0013 Extension
1. Federal Acquisition Regulation (FAR) 6.303-2(b)(1) – Identification of the agency and the contracting activity, and specific identification of the document as a “Justification for other than full and open competition.”
This document is a justification for other than full and open competition prepared by
National Aeronautics and Space Administration (NASA) Goddard Space Flight Center/Wallops Flight Facility (GSFC/WFF).
The procuring agency is the National Aeronautics and Space Administration (NASA) and the contracting activity is Goddard Space Flight Center/Wallops Flight Facility (GSFC/WFF).
2. FAR 6.303-2(b)(2) – The nature and/or description of the action being approved:
This justification provides the rationale for contracting by other than full and open competition to award a six (6) month sole source extension to contract number 80GSFC19C0013 with KBR Wyle Services LLC for continuation of services under the NASA Range Operations Contract II (ROC-II).
The current ROC-II contract was awarded on August 10, 2019 and expires on February 8, 2025. Award of the follow-on contract, Wallops Range Contract (WRC) is currently anticipated for April 1, 2025, followed by a 60-day phase-in period resulting in a contract start date of June 1, 2025. The Government received more proposals than originally anticipated, resulting in an adjustment of the overall procurement timeline. Based on prior Source Evaluation Board (SEB) history, for contracts similar in value and scope, with a similar volume of offerors, the SEB team anticipates it will take through the mid of March 2025 to evaluate proposals, conduct discussions with the offerors in the competitive range, select the contractor, and award the WRC contract.
The Wallops Range has an extremely busy and often shifting schedule, management of which are vital to the agency, the center, and other federal and private business partners, and customers. This includes sounding rocket campaigns, Department of Defense missions and support, and maintenance and sustainment operations. Successful outcomes for these missions depend on the heritage knowledge of safety and mission critical systems, the management structure, and the personnel with mission specific knowledge currently supporting the Range. The extension being requested will allow continuity of critical operations through this period of transition from ROC-II to the new WRC contract. It will also allow contract transition to occur without sacrificing critical services required to maintain stable operations of the Wallops Range and its customers and allow a smooth transition with minimal risk to in-work mission activities.
3. FAR 6.303-2(b)(3) – A description of the supplies or services required, to meet the
Agency’s needs (including the estimated value):
The ROC-II contract provides Wallops Range operations and maintenance; support services;
training; command, control, communications, information, and computer systems services;
testing, modifying, and installing communications and electronic systems at launch facilities, launch control centers and test facilities; range sustaining engineering services, and ground operations support.
In order to provide current and future support, the ROC-II contract also provides ongoing preventive and corrective maintenance and sustaining engineering tasks to ensure readiness and mitigate the effects of obsolescence of current Range equipment, systems, and infrastructure.
The current contract value is $250M with current obligations of $184,170,838.84 and an overall task order awarded value of as of modification P00099 and the last task order issued. The Government’s cost estimate for the planned extension is
, thus an increase in the contract value is not required as this amount can be absorbed within the current available contract ceiling of . The planned extension performance period is February 8, 2025, to August, 9, 2025.
4. FAR 6.303-2(b)(4) – An identification of the statutory authority permitting other than full and open competition:
The statutory authority permitting other than full and open competition is 10 U.S.C.
3204(a)(1), as implemented by FAR 6.302-1(a)(2)(iii)(A) and (B), only one responsible source and no other supplies or services will satisfy agency requirements.
5. FAR 6.303-2(b)(5) – A demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited:
The rationale supporting the use of 10 U.S.C. 3204(a)(1) is only one responsible source and no other supplies or services will satisfy agency requirements as implemented by FAR 6.302- 1(a)(2)(iii)(A) and (B) as further described below.
A sole source award to KBR for a 6-month extension is necessary due to the critical and unique nature of the work being performed under this contract. KBR has the combined training, experience, and expertise to provide uninterrupted continuation of mission critical support as they are the incumbent contractor. Since the functions under the ROC-II contract are to be continued, detailed knowledge of the existing ROC-II requirements greatly aids the contractor’s ability to effectively, and efficiently manage the ongoing tasks, projects, and mission sets in a safe, timely manner during the planned extension period. This will benefit the Government through lower cost and reduced technical and mission risk. KBR is the only source that is qualified to perform this work within the needed time frame due to the immediate need for these services and requirement for uninterrupted continuation of support.
A sole source award to KBR for the contract extension period is necessary due to the need for technical and management continuity for in-process maintenance and sustainment activities, scheduled NASA Sounding Rocket mission support, and support of all NASA customer projects (RocketLab, Antares, DoD Mission Partners) scheduled during the extension period. Lack of support throughout the extension period can result in mission delays or cancellations, precipitating in possible loss of use for critical Government assets, increased safety risk, or increased cost due to mission slips.
The main goal of the ROC-II contract is to provide Wallops Range operations and maintenance; support services; training; command, control, communications, information and computer systems services; testing, modifying and installing communications and electronic systems at launch facilities, launch control centers and test facilities; range sustaining engineering services, and ground operations support. It takes unique skills and abilities to support NASA missions and customers, while understanding the specialized assets and equipment deployed all over the world requiring specific training and certifications to operate. The incumbent contractor has the workforce with the demonstrated capability of executing the complex nature of ROC-II contract.
6. FAR 6.303-2(b)(6) – A description of the efforts made to ensure that offers are solicited from as many potential sources as practicable, including whether a notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies:
A notice to the Government Point of Entry (GPE) website (Sam.gov) was published on October 30, 2024, in accordance with FAR Subpart 5.2. This posting informed potential sources of NASA’s intent to award this sole-source extension to KBR. The results of this synopsis are summarized in Section 10 below.
7. FAR 6.303-2(b)(7) – A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable:
The Contractor will not be required to submit a proposal to be evaluated and negotiated by the Government due to the inclusion of CY6 rates at the time of the initial contract award, CY6 rates were determined to be fair and reasonable.
8. FAR 6.303-2(b)(8) – Description of the market research conducted, and the results, or a statement of the reasons market research was not conducted:
An analysis was performed and review of current General Services Administration Schedules and the NASA Office of Procurement Strategic Sourcing Repository (NFS 1805.70) for existing contracts capable of meeting the requirements as defined in the SOW and found no schedule available that meets our requirements. Formal market research was not conducted for this requirement, as this would be a duplication of effort being conducted currently for the new WRC contract. There is no known company that can establish the necessary processes, controls, specific management structure, and historical technical knowledge in the allotted time frame and for the minimal duration required without an unacceptable delay to mission critical support and cost impact to the Government. The Government is on schedule to conclude the competitive follow-on award within the period of this extension request.
9. FAR 6.303-2(b)(9) – Any other facts supporting the use of other than full and open competition:
None.
10. FAR 6.303-2(b)(10) – A listing of the sources, if any, that expressed an interest in writing in the acquisition:
A notice of NASA’s intent to award this sole-source action was synopsized on the GPE website (Sam.gov) per FAR Subpart 5.2 (See Section 6 above). The synopsis was posted for 15 days from October 30, 2024 to November 15, 2024. One company, , expressed interest, responded to the posting, and provided a capability statement. However, after review of capability statement it was determined that the vendor was not capable of completing the work under the ROC-II requirement. A thorough review of the provided capability statement yielded insufficient information to determine the respondent’s experience, skills, staff, and expertise specific to large portions of the essential services being extended under this contract, namely on-site mobile electric power / hydro-mechanical services, ground operations support including vehicle and payload processing capabilities, WAN services, video and photo optical, and logistics and support services.
details capabilities through developed software for integrated range services as opposed to actual services provided like those required during ROC-II contract performance. Further deeping the gaps in demonstrated capabilities would not have the historical knowledge of current and future missions or ability to get the staff in place to keep operations going uninterrupted.
Furthermore, switching contractors during the proposed extension period would disrupt current and future mission support services impacting the GSFC/WFF and all mission customers. These delays would increase costs to the government, increase safety risks and delay mission schedules while implementation and phase-in timelines are established.
Extending services with the incumbent contactor provides the best overall benefit to the government in fulfilling this requirement.
11. FAR 6.303-2(b)(11) – A statement of actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required:
The Agency continues work on the follow-on acquisition that is being conducted as an competitive full and open procurement.
