About this file
This is a Justification and Approval for Other Than Full and Open Competition for a Simplified Acquisition dated July 27, 2026, with PR Number 44040480. The document supports a sole-source procurement for repair services on a John Deere 85G Excavator rotary manifold, classified as an "Only One Responsible Source" justification under FAR 13.106-1.
The procurement requires removal, inspection, and reconditioning of the rotary manifold—a mission-critical hydraulic component enabling 360-degree swing functionality for equipment used in track maintenance on the Cuyahoga Valley Railroad. The requirement is manufacturer-specific, as the 10-port rotary manifold assembly and associated seal kits are proprietary components designed to OEM specifications. Murphy Tractor, classified as a Large Business under NAICS code 811310, is identified as the only John Deere Certified Dealer in proximity to the park in the Cleveland/Akron metro area capable of performing these repairs. Other certified dealers are located more than one hour away, which would result in additional reassembly, transportation, and diagnostic costs. The justification cites operational urgency: the excavator is currently disassembled at Murphy Tractor pending hydraulic leak diagnostics, and recent heavy rains have caused mudslides affecting railroad tracks requiring immediate attention. Failure to repair timely could result in railroad track closure and cessation of train operations for the nonprofit park partner. The procurement supports NPS operational readiness under 54 U.S.C. §100101(a). Section 3 regarding market research results remains blank in the document. The contracting officer (Ryan Begany) and project officer (Joe Simkanin) certified the justification on July 27, 2026. No approval signature from a warranted individual one level above the contracting officer is present.

JUSTIFICATION & APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION
FOR SIMPLIFIED ACQUISITIONS OVER $10,000 ($2,000/$2500 for
Construction/Services) AND UP TO $250,000 (See FAR 13.106-1)
Date: 07/27/2026 PR Number: 44040480
1. Nature and/or description of the item/service being procured and its intended use (include the anticipated cost):
The John Deere 85G Excavator rotary manifold requires removal, inspection, and reconditioning due to operational deficiencies impacting hydraulic system performance. The rotary manifold is a mission-critical hydraulic component that enables 360-degree swing functionality and safe equipment operation. Failure to repair risks hydraulic leakage, loss of control, equipment downtime, and potential health/life/safety hazards to operators and ground personnel. This John Deere Excavator is a critical piece of equipment to perform track maintenance on the Cuyahoga Valley Railroad.
2. Sole Source Justification rationale (Check one and explain below):
X Only One Responsible S ource.
Urgent and compelling circumstances exist. Include critical delivery or performance dates, and when you became aware of the requirement. Provide a specific statement of the impact on Government operations, financial or otherwise, if the required delivery or performance dates are not met.
Other:
Explain:
This requirement is manufacturer-specific to John Deere equipment. The rotary manifold assembly (10-port configuration) and associated seal kits are proprietary components designed to OEM specifications.
Compatibility, warranty protection, and operational integrity necessitate procurement of John Deere-approved parts and qualified service support. Substituting non-OEM components may compromise system performance, increase failure risk, and create liability exposure.
Murphy Tractor is the only John Deere Certified Dealer that is close to the Park in the Cleveland/ Akron metro area and the surrounding areas. Murphy Tractor is classified as a Large Business under NAICS code 811310 with a Size Standard of $12.5 million. Other dealers John Deere Certified dealers are in excess of an hour away from the park. These other Murphy Tractor locations are also classified as Large Businesses under NAICS code 811310 and no certified Small Business that are John Deere Certified Dealer which are capable of conducting these repairs exist. If the park outsourced this requirement to another Certified John Deere Dealer that is further away there will be additional cost to reassemble the machine and transportation costs.
Another Dealer would have their own diagnostic fees on top of the current dealership diagnostic fees.
The machine is currently sitting inside at Murphy Tractor taken apart from the diagnostics of the hydraulic leak. This machine is our only machine to do maintenance of the railroad track. With the recent heavy rains we have received there are mud slides that are affecting the railroad track and need immediate attention with this machine to correct the mud slide issues. If these are not corrected in a timely manner this could affect the nonprofit park partner in their train operations. This could cause the railroad tracks to be closed and would stop all Train Operations.
Timely repair supports NPS operational readiness under 54 U.S.C. §100101(a), ensuring the preservation and continued public enjoyment of park resources by maintaining functional heavy equipment required for infrastructure maintenance, resource protection, emergency response, and visitor services. Delayed repair would negatively impact project timelines and increase overall lifecycle repair costs.
Based on proprietary part requirements, equipment compatibility, and operational urgency, this procurement meets the criteria for limited-source justification to maintain safe and reliable mission execution.
3. Market Research. Please explain the results or why one was not performed. State whether any other offers were received or anyone expressed interest:

4. If this is a determination for sole source, the contracting officer certifies:
a. Only one source is available, or urgent and compelling circumstances exist.
b. The anticipated price will be determined fair and reasonable using the price analysis techniques described in FAR Part 13.106-3(a).
