About this file
This is a Simplified Acquisition Limited Source Justification for acquisitions under $150K from the Department of Health and Human Services, Indian Health Service (IHS). The document justifies a sole-source purchase order for RL Datix to provide software licensing for an Adverse Events Reporting System.
The justification covers a three-month bridge contract valued at $64,388.00 for the period of December 9, 2024, through March 8, 2025. The bridge contract is needed to prevent a lapse in critical services while allowing time to recompete the existing contract 75H70424P00029 which expires December 8, 2024. RL Datix, located in Chicago, IL, is identified as the only acceptable source due to potential operational delays with a new vendor, including ATO certification requirements, staff training needs, and risks of data loss during system transitions. The system is deemed critical for IHS's ability to report medical and non-medical adverse events and maintain proper oversight of patient safety.

SIMPLIFIED ACQUISITION LIMITED SOURCE JUSTIFICATION
FOR ACQUISITIONS UNDER $150K
Activity: The Department of Health and Human Services, IHS, proposes entering into a purchase order on a basis of other than full and open competition for the following acquisition as implemented by FAR Subpart 13.106-1(b)
(1) - Exclusive Licensing Agreement.
1. Requisition: IHS1504848
2. Description of Supplies or Services:
Software license that reports medical and non-medical adverse events, a critical requirement for maintaining proper oversight. Estimated Value of Procurement: Three (3) month base period valued at $64,388.00.
3. Recommended Sources:
RL Datix. located at 155 N Wacker Dr., Ste. 1930, Chicago, IL 60606-1719
4. Reason for Sole Source/Limited Sources/Expedited Processing:
[X] Extend existing Licensing Agreement - Prevent a lapse in critical service.
5. Briefly Explain: Professional organization memberships are allowable per the FAR, Section 31.205-43, Only one (1) source, RL Datix, is available to fulfill the Government’s requirement for an Adverse Events Reporting System. This action will support a short-term, three (3) month bridge to allow for adequate time to re-compete the existing contract 75H70424P00029 with a current expiration date of December 8, 2024, maximize future competition, and prevent a lapse in critical services.
Should a lapse in service occur, IHS would have no way to report medical and non-medical adverse events, a critical requirement for maintaining proper oversight. Adverse reporting may require rapid intervention on behalf of IHS leadership and management, and its absence may result in potentially endangered patient safety.
Due to the criticality, for the period to be covered (December 9, 2024, through March 8, 2025), RL Datix is the only acceptable source for this period as an alternate vendor would incur unacceptable delays:
6. Impact to Government if not awarded in accordance with the above:
1. Operational delays would be encountered in the implementation of a different software. This process includes obtaining the Authority to Operate (ATO) certificate from IHS IT security, and would likely exceed the duration of the anticipated bridge.
2. IHS Staff training and acclimation to new software for a three (3) month period.
3. Potential loss of data bridging between the systems, without sufficient time to identify gaps in database construction between solutions.
7. Point of Contact/Approval:
