About this file

This document is a Justification and Approval (J&A) for Other Than Full and Open Competition (>SAT) for an emergency sole source contract to repair the steam line between Buildings 147 and 121 at the Dayton VA Medical Center.

The proposed action is a new, firm-fixed-price contract for Project No. 552-24-102 to replace the leaking alternate steam delivery line, which serves as the backup system. Without these repairs, the backup system will fail, leaving the medical center without a functioning steam delivery system. Due to the urgent nature of this work to ensure patient safety and facility operations, the VA determined that Ed Rike Plumbing, a SDVOSB, is the only source capable of quickly mobilizing and performing the required work. The estimated cost is $2,509,768.44, with a 180-day period of performance. The J&A was approved by the Head of Contracting Activity on 8/14/24.

DEPARTMENT OF VETERANS AFFAIRS

Justification and Approval (J&A) For

Other Than Full and Open Competition (>SAT)

Acquisition Plan Action ID: 36C250-24-AP-4138

1. Contracting Activity: Department of Veterans Affairs, VISN 10, Network Contracting

Office (NCO) 10. 2780 Airport Drive, Suite 340, Columbus, Ohio 43219.

PR: 552-24-4-6932-0050

2. Nature and/or Description of the Action Being Processed: The proposed action is for an emergency sole source contract for Project No. 552-24-102- Replace Steam Line Boiler Plant to Shed. The steam line runs underground between Buildings 147 and 121. The contract will be awarded as a new, firm-fixed-price contract.

3. Description of Supplies/Services Required to Meet the Agency’s Needs: The alternate steam line is designed to work simultaneously with the primary steam delivery line. If needed, it functions as the fail-safe, backup steam delivery line, in the event the main steam delivery line needs repair or fails to function properly. Maintenance will be performed on the primary steam delivery line. At that time, the primary delivery steam line will be shut down and the alternate delivery steam line will function as the steam distribution line for the medical center.

The alternate steam delivery lines are leaking in several spots and must be repaired. Without the repairs to the alternate steam lines, the backup steam delivery system will fail, and the VA Medical Center will not have a functioning steam line. It is critical that this work be completed now to ensure the Medical Center has a fully operational back-up steam system to prevent the potential negative impact on patient safety, life safety and facility operations.

The Period of Performance to accomplish this project is 180 days from receipt of Notice to Proceed. The estimated cost, via the Independent Government Cost Estimate (IGCE), is $2,509,768.44.

4. Statutory Authority Permitting Other than Full and Open Competition:

( ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per 41 USC §3304(a)(1) as implemented by FAR 6.302-1;

(X) (2) Unusual and Compelling Urgency per 41 USC §3304(a)(2) as implemented by FAR 6.302-2;

( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per 41 USC §3304(a)(3) as implemented by FAR 6.302-3;

( ) (4) International Agreement per 41 USC §3304(a)(4) as implemented by FAR 6.302-4

( ) (5) Authorized or Required by Statute per 41 USC §3304(a)(5) as implemented by FAR 6.302-5;

( ) (6) National Security per 41 USC §3304(a)(6) as implemented by FAR 6.302-6;

( ) (7) Public Interest per 41 USC §3304(a)(7) as implemented by FAR 6.302-7;

5. Demonstration that the Contractor’s Unique Qualifications or Nature of the

Acquisition Requires the Use of the Authority Cited Above (applicability of authority):

Without the repairs to the alternate steam lines, the backup steam delivery system will fail, and the VA Medical Center will not have a functioning back-up system in the event the primary steam line needs repair or fails. It is critical that this work be completed now to ensure the Medical Center has a fully operational back-up steam system to prevent the potential negative impact on patient safety, life safety and facility operations.

The time involved to competitively bid and award the project would significantly delay these critical, required repairs to the backup system. The system described in section III above is essential for the proper functioning of the Medical Center and to preclude impairment of healthcare delivery capabilities and mission performance. Ed Rike Plumbing’s services have been used extensively at the Dayton VA for the past several years. During this time, their performance has been better than satisfactory, the facility is extremely satisfied with the services provided, and they are great business partners to the VA and Federal Government.

Ed Rike Plumbing, a VetCert-certified SDVOSB, has the capabilities and expertise necessary to complete this work and is ready to quickly mobilize.

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: VetCert, SAM, and SBA Dynamic Small Business Search (DSBS) searches produced results that indicate that there are several potential sources to perform this work. The search produced 1,859 possible SDVOSB/VOSB/JV entities via VetCert, 123 possible SDVOSB entities via SAM, and 40 possible entities via SBA DSBS.

7. Determination by the CO that the Anticipated Cost to the Government will be Fair and

Reasonable: The Government will evaluate the proposed price against the IGCE and similar projects awarded recently. Additionally, the Contracting Officer will use any other price analysis techniques in FAR 15.404-1 to determine the price to be fair and reasonable.

8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: As described in section VI above, market research was conducted using data found on SBA DSBS, VetCert and SAM.gov.

Despite the identification through market research of several potential sources to perform this work, due to the urgent nature of this work, it was determined that there is only one (1) source that possesses the capabilities and resources to mobilize quickly and perform this work. Accordingly, the VA Rule of Two cannot be satisfied.

9. Any Other Facts Supporting the Use of Other than Full and Open Competition: None.

10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition:

Ed Rike Plumbing, Inc.

7667 Verona Rd.

Lewisburg, OH 45338

VHAPG Part 806.3 OFOC Page 3 of 4

11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any

Barriers to Competition before Making subsequent acquisitions for the supplies or services required: Market research will be conducted to identify potential sources for any future work of this nature.

12. Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
