About this file
Summary
This is a Justification for Other Than Full and Open Competition document from the U.S. Department of the Treasury, Bureau of Engraving and Printing (BEP), seeking to award a sole-source contract to Protec Surface Technologies SRL for preventative maintenance services. The contract covers maintenance for four IPC 1100 PVD (Physical Vapor Deposition) machines already owned by BEP, with the contract type being Firm-Fixed and Commercial. The justification is based on FAR 6.302-1 (Only One Responsible Source), as Protec Surface Technologies SRL is the Original Equipment Manufacturer and the only authorized service provider capable of maintaining this specialized equipment.
The agency determined that only the OEM possesses the proprietary knowledge, software, and specialized expertise required to maintain the equipment in accordance with manufacturer specifications and preserve warranty coverage. Market research confirmed that no other commercial sources are authorized or capable of providing the required maintenance, calibration, inspection, and repair services for the specific PVD machines. A Special Notice of Intent to Sole Source will be published on SAM.gov for 15 days to identify any additional responsible sources. The Contracting Officer will determine fair and reasonable pricing prior to award using historical pricing, commercial pricing information, the Independent Government Cost Estimate, and relevant market information. Policy Tracking number is BEP-26-AP-0199, and the document includes certifications and approvals from multiple levels of procurement authority including the Competition Advocate, Bureau Chief Procurement Officer, and Senior Procurement Executive.

D. DEMONSTRATION THAT THE PROPOSED CONTRACTOR'S UNIQUE QUALIFICATIONS
OR THE NATURE OF THE ACQUISITION REQUIRES USE OF THE AUTHORITY CITED.
The proposed contractor's unique qualifications and the nature of the acquisition require use of the authority cited as follows:
1. The OEM/Contractor possesses proprietary knowledge of the design, technology, and engineering of the PVD system model IPC1100, enabling specialized services tailored to the equipment.
2. The OEM/Contractor maintains specialized training and expertise regarding the proper operation and maintenance requirements of the system.
3. The software required to properly operate and maintain the system is proprietary, and the OEM retains full and exclusive intellectual property rights to the software.
4. Performance of maintenance services by unauthorized third-party service providers will void the manufacturer's warranty.
Failure to utilize an authorized OEM service provider could adversely impact the Government operationally and financially by increasing the risk of equipment failure, operational downtime, improper maintenance, and loss of manufacturer warranty protections. Due to the proprietary nature of the equipment, OEM-controlled software, technical knowledge, and specialized maintenance requirements, the Government has determined that only the OEM is capable of providing the required preventative maintenance services. Therefore, it is in the best interest of the Government to award this requirement as a sole-source firm-fixed-price contract pursuant to FAR 6.103-1, Only One Responsible Source and No Other Supplies or Services will satisfy agency requirements.
E. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE SOLICITED FROM
AS MANY POTENTIAL SOURCES AS IS PRACTICABLE, INCLUDING WHETHER A
NOTICE WAS OR WILL BE PUBLICIZED AS REQUIRED BY FAR SUBPART 5.2 AND, IF
NOT, WHICH EXCEPTION UNDER FAR 5.202 APPLIES.
The initial procurement for the PVD Machine was the result of a competitive best value solicitation under RFP # 2031ZA20R00031, . Under this solicitation, there was no restriction on manufacturer or model. Offerers were permitted to propose any system that satisfied the Government's specifications and minimum requirements. Protec Surface Technologies SRL presented the best value solution to the Government with the lowest performance risk and highest confidence rating.
For this preventive maintenance service requirement, a Special Notice of Intent to Sole Source will be published on SAM.gov in accordance with FAR Subpart 5.2 for a period of fifteen (15) days to identify any additional responsible sources capable of meeting the Government's requirements.
Version No.: 3
F. DETERMINATION BY THE CONTRACTING OFFICER THAT THE ANTICIPATED COST TO
THE GOVERNMENT WILL BE FAIR AND REASONABLE.
Prior to award, the Contracting Officer will determine that the anticipated cost to the Government is fair and reasonable in accordance with FAR 15.404-1(b}, Price Analysis Techniques and Procedures.
The Government will evaluate pricing using available historical pricing, commercial pricing information, the Independent Government Cost Estimate (IGCE}, and any other relevant market information available.
G. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED (SEE FAR PART 10) AND
THE RESULTS OR A STATEMENT OF THE REASON MARKET RESEARCH WAS NOT
CONDUCTED.
Market research was conducted to identify potential sources capable of providing preventive maintenance, calibration, inspection, and repair services for the Government-owned plating machines. Research included consultation with the Original Equipment Manufacturer (OEM}, a review of previous solicitation information, and an evaluation of commercially available vendor information.
The review of the previous solicitation identified multiple offerors that were capable of manufacturing and supplying plating machines. However, the previous procurement did not identify those offerors as being authorized or capable of providing preventive maintenance, calibration, inspection, or repair services for the specific PVD plating machines currently owned by the Bureau of Engraving and Printing (BEP).
Additionally, commercially available vendor information identified several companies that provide plating services as part of their business operations. However, these companies perform plating processes as a commercial service and do not provide maintenance, inspection, calibration, or repair services for Government-owned plating equipment. Market research did not identify any commercial source, other than the OEM, that is authorized or capable of providing maintenance services for the specific plating machines owned by BEP.
The OEM subsequently confirmed in writing that it is the only authorized service provider for the subject equipment and that it does not authorize third-party companies to perform the required maintenance services. This written confirmation corroborated the results of the Government's independent market research, which identified no other responsible source capable of satisfying the Government's requirement. Accordingly, the Government has determined that only one responsible source is capable of fulfilling the agency's needs in accordance with FAR 6.103-1.
Version No.: 3
H. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND OPEN
COMPETITION.
The required preventive maintenance services require the use of the OEM's proprietary equipment, software, diagnostics, technical data, and maintenance procedures necessary to maintain the Government-owned PVD plating machines in accordance with the manufacturer's specifications. The OEM has confirmed that it is the only authorized service provider for the subject equipment and that maintenance performed by any unauthorized third party will void the manufacturer's warranty. Use of an unauthorized service provider would jeopardize warranty coverage, increase the risk of equipment failure and unplanned downtime, and adversely affect the reliability and operational availability of this mission-critical equipment. Accordingly, only the OEM is capable of providing the required maintenance services while preserving the manufacturer's warranty and ensuring continued equipment reliability.
I. LISTING OF THE SOURCES, IF ANY, THAT EXPRESSED, IN WRITING, AN INTEREST IN
THE ACQUISITION.
As of the date of this justification, no additional sources have expressed, in writing, an interest in the acquisition.
J. STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO REMOVE OR
OVERCOME ANY BARRIERS TO COMPETITION BEFORE ANY SUBSEQUENT
ACQUISITION FOR THE SUPPLIES OR SERVICES REQUIRED.
The Government will continue to conduct market research prior to future acquisitions to determine whether additional authorized service providers become available or whether market conditions change in a manner that would increase competition for future requirements.
