MEMORANDUM FOR RECORD
SUBJECT: Justification for Other Than Full and Open Competition (JOFOC)
1. References:
a. RFQ W912K6-22-Q-0003, subject, The Baltimore Sun newspaper Ads
b. Federal Acquisition Regulation (FAR) 11.105, “Items Peculiar to One
Manufacturer”.
c. FAR 13.501 (a) (1) (i), “Special Documentation Requirements”.
d. Memorandum, Recruiting & Retention Battalion, MDARNG, 28 JAN 22, Subject:
Justification For Other Than Full and Open Competition: Sole Source Justification of
Baltimore Sun Media Services
2. Identification of Agency: USP&FO For Maryland Contracting Activity, 301 Old Bay Lane, State Military Reservation, Havre de Grace, Maryland 21078.
3. Description of Action Being Approved: Use of Item Peculiar to One Market Source
Newspaper and Media Services for Advertising as required by reference d above.
4. Description of Services: Print and online media advertising covering the entire state of
Maryland.
5. Statutory Authority: The statuary authority permitting other than full and open competition is
FAR 6.302-1 and 10 U.S.C. 2304 (c) (1), or 41 U.S.C. 3304(a) (1), where the agency’s requirement is available from only one responsible source.
6. Solicitation of Potential Offers: This JOFOC is being posted to FBO to verify the market research.
7. Price Reasonableness Determination: The rates offered to the RRB are the same as their published rates to the general public for print and media advertising.
8. Other Facts Supporting Justification: Market Research indicates that no other state wide newspapers are known to exist. The Baltimore Sun also controls all other local newspapers except 2 locals where it co-competes.
9. Approval: The above justification is accurate and complete to the best of the contracting officer’s knowledge and belief. The use of the services peculiar to one company for this acquisition is approved by the undersigned.
