7. FAR 6.303-2(b)(7) – A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable:

The ordering office anticipates a reasonable-priced offer from the publisher. Historical prices found reasonable on previous purchases are available and will be used for comparison in the proposal analysis to determine if proposed prices are reasonable. Additionally, the Ordering Office shall also request a current commercial price list and redacted copies of recent relevant invoices to further ascertain the reasonableness of the pricing offered. The ordering office is unaware of any issues that would circumvent a fair and reasonable price determination.

8. FAR 6.303-2(b)(8) – Description of the market research conducted, and the results, or a statement of the reasons a market research was not conducted:

The ordering office reviewed and found the requirements for fiscal year 2022 cannot be met through a contract source for mandatory-use as identified in PN (procurement notice) 19-12 Appendix A – Enterprise Procurement Strategies; therefore, in accordance with FAR 8.004(a)(1), the ordering office will make use of other sources available.

Using the product code and description for each item, the ordering office initiated a review of the Solution for Enterprise Wide Procurements (SEWP), General Services Administration (GSA) Advantage, and conducted a targeted internet search for value-added resellers.

Results from market research are absent any vendor capable of fulfilling the requirement to provide maintenance services for the required software; the perpetual software maintenance is not available via GSA Federal Supply Schedule (FSS) contracts.

Market research confirmed the requirement is a commercial item. A distribution network for the software does not exist within the borders of the United States. According to CRTech, Autodesk Inc has authorized CRTech to sub-lease the perpetual licenses to NASA. The 21 March 2022 email confirming CRTech’s authorized Autodesk dealer status will be included in the award file.
