About this file
This is a Single Source Justification for a simplified acquisition by the Department of Veterans Affairs, Network Contracting Office 15, acting on behalf of the Lancaster (Dallas) Consolidated Mail Outpatient Pharmacy (CMOP) Division. The contracting activity seeks to award a sole-source contract to KNAPP to restore 96 A-Frame channels and associated components in the pharmacy's automated dispensing system. The required services include providing original equipment manufacturer (OEM) parts (guides, rails, uprights, cross braces, and hardware), installation labor, diagnostic lighting integration, ejector motor programming and commissioning, final testing, documentation, and warranty coverage to ensure full system functionality and OEM warranty continuity.
The justification establishes that KNAPP is the only viable source because the A-Frame equipment is proprietary to KNAPP, and no other manufacturer can provide authorized replacement components, OEM diagnostic tools, or factory configuration files. Only KNAPP technicians are factory-trained and licensed to perform the required configuration, programming, and commissioning work; non-OEM installation would void warranties and create unacceptable operational and patient-safety risks to the medication fulfillment operations. Market research conducted beginning April 13, 2026, confirmed that no distributors, resellers, or third-party service firms are authorized or technically capable of performing this work. The contracting officer certified the justification on April 20, 2026, in accordance with FAR 13.106-1(b) for an acquisition valued over the micro-purchase threshold but not exceeding the simplified acquisition threshold. The applicable NAICS code is 332999, and the Non-Manufacturer Rule does not apply to this large-business, sole-source award. The Buy American Act applies as the controlling domestic preference statute, with the Trade Agreements Act deemed inapplicable to sole-source awards.

VHAPG Part 813.106 Simplified Acquisition Procedures: Soliciting from a Single Source Attachment 1: Single Source Justification for MPT up to SAT
DEPARTMENT OF VETERANS AFFAIRS
Justification for Single Source Awards IAW FAR 13.106-1 For
Over Micro-Purchase Threshold but Not Exceeding the Simplified Acquisition Threshold
Acquisition Plan Action ID: 36C770-26-AP-0362
Revision: 02
1. Contracting Activity: The Department of Veterans Affairs, Network Contracting Office (NCO) 15 - Consolidated Mail Outpatient Pharmacy (CMOP) Division on behalf of the Lancaster (Dallas) CMOP.
• 2237# 763-26-3-228-0355
2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount:
• KNAPP shall provide OEM parts, installation labor, diagnostic light integration, ejector motor programming, commissioning, final testing, documentation, and warranty coverage necessary to restore 96 A-Frame channels and associated components.
i. Requirements include:
1. OEM guides, rails, uprights, cross braces, and hardware along with installation
2. Integration of diagnostic lighting
3. Programming and commissioning of ejector motors, memory chips, and diagnostics
4. Ensuring full system functionality and OEM warranty continuity
3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used:
• A sole-source award to KNAPP is justified because:
o The A-Frame equipment is proprietary to KNAPP. No other manufacturer can provide authorized replacement components, OEM diagnostic tools, or factory configuration files.
o Only KNAPP technicians are factory-trained and licensed to perform configuration, programming, and commissioning of ejector motors and diagnostic lighting systems, as required by the PWS.
o Warranties require OEM installation. Any non-OEM work would void warranties and violate the Government's requirement for OEM compliance and warranty protection.
Effective Date: 12/30/2025 Page 1 of 3 Acquisition ID# 36C770-26-AP-0362 o No other vendors have access to KNAPP's proprietary software, firmware, memory chip data, or calibration protocols, all of which are essential to restoring factory functionality.
o The A-Frame must remain operational during production hours.
Attempting installation by a non-OEM vendor introduces unacceptable operational and patient-impact risk.
o Market research confirmed that no distributors, resellers, or third-party service firms are authorized or technically capable of performing this work.
• If KNAPP is not used:
o A-Frame equipment may fail or remain in degraded operation o Warranty coverage will be voided o Medication fulfillment operations may be disrupted o Patient safety and timely delivery of prescriptions may be affected o The Government risks equipment damage due to uncertified installation or programming
4. Description of market research conducted and results or statement why it was not conducted:
• In accordance with FAR Part 10, V AAR 810, and V AAM M810 market research has been conducted for this acquisition. The procurement package was received on March 19, 2026, and market research efforts commenced on April 13, 2026.
• The A-Frame equipment is proprietary technology manufactured solely by KNAPP. Only KNAPP has the OEM rights, software access, configuration files, diagnostic tools, and specialized equipment needed to restore the system to factory configuration. Third-party vendors cannot obtain OEM parts or access the proprietary programming, diagnostics, or memory configurations required for proper operation. Use of non-OEM personnel would void warranties, violate OEM specifications, and create unacceptable operational risk.
• Because the Dallas CMOP relies on continuous A-Frame operation to maintain medication fulfillment, the Government cannot accept reverse-engineered, experimental, or non-OEM methods. KNAPP retains exclusive control over all firmware, encoding protocols, training, and certification necessary to perform modifications, component replacements, and commissioning, including proprietary control of ejector motors, diagnostic lighting systems, memory addressing, and channel programming.
• The commercial marketplace does not support non-OEM sources for the required A-Frame guides or for installation and commissioning of KNAPP equipment. This aligns with broader industry norms in automated dispensing systems, where OEMs maintain exclusive authority over technical support, configuration, and system restoration.
Revision: 02 Effective Date: 12/30/2025 Page 2 of 3
• As part of market research, the Contracting Officer also reviewed Contract Award 36C77026P0254. Although this award did not involve KNAPP, it confirmed the industry-wide practice that manufacturers of proprietary automated dispensing systems restrict installation, configuration, and technical work to their own certified technicians, further supporting OEM exclusivity.
• The Contracting Officer reviewed the Non-Manufacturer Rule (NMR). The applicable NAICS code (332999) has no class waivers, and the NMR applies only to small business set-asides above the micro-purchase threshold.
Because this acquisition is a large-business, sole-source award and not a small-business set-aside, the NMR does not apply.
• Finally, the Buy American Act (BAA) applies to this requirement. Under RFO
25.401, the Trade Agreements Act (TAA) does not apply to sole-source awards. As this action will be a large-business, sole-source award to KNAPP, T AA is inapplicable and BAA remains the controlling domestic preference statute.
5. Contracting Officer's Certification: Purchase is approved in accordance with FAR
13.106-1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief
