TO FAIR OPPORTUNITY

1. Identification of the requiring activity and the contracting activity:

The requiring activity is IRS Applications Development, Compliance and the contracting activity is IRS, Procurement, Office of Information Technology Acquisition

2.a Nature and/or description of the action being approved:

The purpose of this Justification for an Exception to Fair Opportunity is to obtain approval to award a Firm-Fixed-Price (FFP) task order to Leidos, Inc to create a virtual inventory system whereby employees can work taxpayer correspondence from their telework locations. The period of performance will be a base period of twelve months.

Base Period: September 20, 2021 – September 19, 2022

3.a A description of the supplies or services required to meet the agency’s needs:

Development, operation, and maintenance of Account Management Services (AMS), Correspondence Imaging Inventory (CII) work related to document scanning and inventory creation. The Contractor shall provide support resulting from legislative, mandates, and critical system changes related to DME work.

3.c IGCE/Estimated dollar value: The IGCE is $2,008,233.60 for a base period of twelve months.

4.a Identification of the exception to fair opportunity being used:

☒ FAR 16.505(b)(2)(i)(A) – The agency need for the supplies or services is so urgent that providing a fair opportunity would result in unacceptable delays.

☐ FAR 16.505(b)(2)(i)(B) – Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized.

☐ FAR 16.505(b)(2)(i)(C) – The order must be issued on a sole-source basis in the interest of economy and efficiency because it is a logical follow-on to an order already issued under the contract, provided that all awardees were given a fair opportunity to be considered for the original order

☐ FAR 16.505(b)(2)(i)(D) – It is necessary to place an order to satisfy a minimum guarantee.

☐ FAR 16.505(b)(2)(i)(E) – For orders exceeding the simplified acquisition threshold, a statute expressly authorizes or requires that the purchase be made from a specified source.

☐ FAR 16.505(a)(4) – The requirement is for an item peculiar to one manufacturer.

4.b Supporting rationale:

Due to the Covid-19 pandemic and the resulting economic relief legislation, the Small

Business/Self-Employed (SB/SE) Collections has taxpayer correspondence backlog of over

800,000 impacting over 1,500 tax examiners. A virtual inventory system whereby employees can work taxpayer correspondence from their telework locations, must be implemented immediately. Only one contractor, Leidos, has the expertise to complete the work in an expeditious manner. Creation of these virtual inventories for the business requires highly specialized skills and existing knowledge of AMS components that only Leidos possess.

Providing a fair opportunity would result in a four month transition period and an increase in the correspondence backlog.

5. A determination that the anticipated cost to the Government will be fair and reasonable:

The Contracting Officer determines that the anticipated price(s) will be fair and reasonable based on comparing prices with prior and similar task orders issued and by performing cost and price analysis techniques.

Should additional services be required beyond the performance period, a competitive solicitation will be issued.
