About this file

This document is a Justification for Exception to Fair Opportunity (JEFO) for a sole source task order to be awarded to Concur Technologies, Inc. for ConcurGov Travel System Support services. The U.S. Secret Service (USSS) requires these services, which include travel system voucher processing, configuration management, training, tier 1 help desk, and custom report training, under the mandatory E-Gov Travel Service (ETS) program. The USSS is proposing a sole source award to Concur Technologies, Inc. under its GSA contract # GS-33F-Y0026, with a total anticipated value of . The JEFO cites FAR 16.505(b)(2)(i)(B) as the basis for the exception, as the ConcurGov software is proprietary to Concur Technologies and they are the only vendor that can meet this requirement under the ETS program. The period of performance is 3 years, from 6/4/2024 to 6/3/2027. The USSS intends to compete the requirement among the awardees of the upcoming ETSNEXT contract when it replaces ETS2 in fiscal year 2027.

Justification for Exception to Fair Opportunity Exceeding the SAT pursuant to FAR 16.505(b)(2)(ii)(B)

JEFO No: FY24-0009 Page 1 of 3

03.21.2022 v.1.0

JEFO Number: FY24-0009 PR Number: PR-24-USSS-2621

1. Agency and Contracting Activity.

The Department of Homeland Security, U.S. Secret Service (USSS), Procurement Division, proposes to award a task order on behalf of Office of the Chief Financial Officer (OCFO), Finance Management Division (FMD), pursuant to Federal Acquisition Regulation (FAR) 16.505(b)(2), Exceptions to the fair opportunity process.

2. Nature and/or description of the action being approved.

The USSS proposes to award a sole source task order through the General Services Administration’s E-Gov Travel Service (ETS) program (ETS 2) to Concur Technologies, Inc. for ConcurGov Travel System Support under its GSA contract # GS-33F-Y0026.

3. Description of Supplies/Services.

The USSS requires ConcurGov Travel System Support, which includes Concur Travel System voucher processing, configuration management, training, tier 1 help desk, and custom report training services.

The period of performance is as follows:

Base Year: 6/4/2024-6/3/2025 Option Year 1: 6/4/2025-6/3/2026 Option Year 2: 6/4/2026-6/3/2027

The total anticipated dollar amount of this proposed action (including option years) is

4. Statutory exception and supporting rationale.

The applicable statutory FAR citation and basis for using an exception to fair opportunity process is:

FAR 16.505(b)(2)(i)(B). Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized.

Exceeding the SAT pursuant to FAR 16.505(b)(2)(ii)(B)

JEFO No: FY24-0009 Page 2 of 3

03.21.2022 v.1.0

Rationale:

E-Gov Travel Service (ETS) is a mandatory solution used by over 124 civilian agencies, which includes DHS/USSS. All of the Chief Financial Officer (CFO) act agencies, except for the Department of Defense, are required to use ETS. DHS is one of the Chief Financial Officer (CFO) act agencies. The ConcurGov software is proprietary to Concur Technologies, Inc. This is the only source that can satisfy USSS’ requirement for ConcurGov Travel System Support under the mandatory E-Gov Travel Service solution.

5. Determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable.

The anticipated price will be fair and reasonable based on the fact that this is an order against an existing GSA ETS2 contract, where prices have been pre-determined to be fair and reasonable.

ETS2 contract does not allow any further discounts on firm fixed price contract line items (CLINs); however, the USSS will seek discounts from the not-to-exceed labor hour CLINs that are eligible for discounts at the order level.

6. Any other facts supporting the justification.

ETS2 has two awardees, but Concur is for the travel system. The other awardee is for travel management (e.g., booking travel). Therefore they are not direct competitors when it comes to our travel system requirement. Concur Technologies, Inc. is the only travel system vendor under ETS2, and they use the ConcurGov travel system, which is proprietary. There are no resellers.

7. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the exception to fair opportunity before any subsequent acquisition for the supplies or services is made.

ETS2 contract GS-33F-Y0026 expires 6/3/2027. GSA will be replacing ETS2 with ETSNEXT in fiscal year 2027. If ETSNEXT is a multiple award contract, the USSS intends to compete among the ETSNEXT awardees to the maximum extent practicable.

8. USSS intends to publish the award notice and make this justification publicly available on SAM.gov pursuant to FAR 16.505(b)(2)(ii)(D).

9. Technical/Requirements Personnel Certification.

Pursuant to FAR 16.505(b)(2)(ii)(B)(9), I certify that this requirement meets the Government’s minimum need and that the supporting data, which form a basis for the justification, are accurate and complete.
