About this file

This document is a Justification for Exception to Fair Opportunity, which provides the rationale for a sole-source award to Northrop Grumman Systems Corporation for the Collaborative Mission Planning Continuum (CMPC) Integration and Scaled Agile Framework contract.

Northrop Grumman has been the prime integrator of the Next Generation Open Mission Systems (NOMS) software since FY2020 and has extensive experience and proficiency developing, integrating, and deploying the NGNMPS product. Transitioning this work to another contractor at this critical juncture between the Mid-Tier Acquisition (MTA) end and Program of Record (POR) start would severely impact POR execution. The Contracting Officer has determined the anticipated cost to the Government will be fair and reasonable, and a sole-source award to Northrop Grumman is a logical follow-on and in the best interest of the government. The award is for $75,998,590.00 and was made on 2024-08-15 by the Department of the Navy Naval Air Systems Command.

Text version

Northrop Grumman has been the prime integrator of NGNMPS Next Generation Open Mission Systems (NOMS) Software since FY2020. The first NGNMPS contract with Northrop Grumman (HQ0727-16-D-0004, HQ072720F1415) was awarded in 2020 by the Defense Microelectronics Activity (HQ), in support of PMA-281, for NOMS Development and Integration, to include studies and analysis, architecture and interface requirements definition, software and user interface development, Scaled Agile Framework (SAFe) operations, integration, DevSecOps, test, and training materials. The current contract was a full and open competition under the PMA-281 MAC IDIQ (N00019-20-D-0024). It was awarded in 2021 and the period of performance ends June 2024. All awardees were given a fair opportunity to be considered for this order.

The scope of the current order includes software development as well as the engineering and technical support needed to deliver the NGNMPS 804 Mid-Tier Acquisition (MTA) products.

Under this contract, Northrop Grumman has developed software, developed and implemented the user interface (UI), data interfaces, architecture models, and technical documentation.

Additionally, they are providing essential support for the Navy and the NOMS mission planning enterprise in the areas of DevSecOps and Model Based Systems Engineering (MBSE). Northrop Grumman personnel currently support key positions in the NOMS SAFe organization (Portfolio, Solution, Agile Release Trains, and Spanning Palette), coordinating the engineering, development, integration, user demonstrations/evaluations, and deployment of the NGNMPS software. They have also done numerous trade studies under this contract.

The follow-on contract is a continuation of the work done under the current contract to include support for SAFe operations, DevSecOps, integration, decomposition of Government requirements to support agile software development, enterprise architecture, MBSE, technical documentation, user demonstrations/evaluations, deployment, and engineering studies.

Given this above history, Northrop Grumman has extensive experience and proficiency developing, integrating, and deploying the NGNMPS product. Their SAFe expertise and experience with its unique implementation in the NOMS enterprise has been key to the current NGNMPS 804 MTA program execution and is needed to support transition to a Program of Record (POR) and the associated expansion of development, integration, and deployment efforts in FY24. Transitioning this work to another contractor at this critical juncture between the MTA end and POR start would severely impact POR execution. Accordingly, a sole source award to Northrop Grumman is a logical follow-on and is in the best interest of the government.

5. A Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable.

The Contracting Officer has determined the anticipated cost to the Government of the supplies/services covered by this Justification for Exception to Fair Opportunity will be fair and reasonable.

6. Any other Facts Supporting the Justification.

If this contract were to be competed and awarded to a company other than Northrop Grumman, impacts to the CMPC program include duplicative costs of $9.5M associated with developing interfaces, architecture models, DevSecOps processes, Model Based Systems Engineering, technical documentation, technical governance, business rules, and NOMS mission planning enterprise SAFe implementation. Additionally, it would delay program execution efforts by at least a year, delaying the full transition from JMPS to CMPC for an additional cost of $6M to maintain and update the JMPS framework, integrate and test MPE updates, and provide cyber security patches (based on historical costs). The duplicative cost estimate reflects the incurred cost the government would realize by going to a source other than Northrop Grumman.

7. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers that Led to the Exception to Fair Opportunity before any Subsequent Acquisition for the Supplies or Services is Made.

The Program Office (PMA-281) continually seeks opportunities to compete software and hardware requirements utilizing its IDIQ multiple-award contract and will continue to do so for any future efforts for NGNMPS/CMPC software, engineering and technical support unless an exception to the fair opportunity process exists in accordance with FAR 16.505(b)(2). PMA-281 intends to compete POR software development efforts under the PMA-281 MAC IDIQ with an award(s) planned in FY24.

NGNMPS/CMPC program and NOMS as detailed in Paragraph 4, it is currently not practicable to compete the engineering and technical support for development, integration, test, delivery, and support of CMPC.
