About this file
This is a Justification for an Exception to Fair Opportunity (JEFO) submitted by the Defense Logistics Agency (DLA) Troop Support, Medical Supply Chain, Capital Equipment Division for the acquisition of medical equipment from BK Medical Holding Company, Inc.
The document justifies a single-source procurement of one bk3000 ultra-high resolution ultrasound system for Portsmouth Navy Medical Center under existing Long-Term Contract (LTC) SPE2D1-19-D-0023 (expiring 12 June 2029), which was originally solicited under SPE2D1-15-R-0001. The waiver authority cited is FAR 16.507-6(b)(2), establishing that only one awardee is capable of providing the required supplies due to unique or highly specialized requirements. The ultrasound system must meet specific minimum clinical requirements including ultra-high resolution capabilities for urological, OB/GYN, and cancer detection diagnosis with Tissue Harmonic Imaging, Real Time Tissue Elastography, and Strain Histogram Measurement functionality; tri-plane transducers enabling three-dimensional visualization without transducer changes during intra-cavity examinations; at least three active transducer ports; dual biopsy guides for biplane and endfire biopsies without transducer changes; and specialized system software for intra-cavity scanning, general examinations, intra-operative procedures with MRI/CT image fusion, and enhanced biopsy precision.
Market research conducted in March 2026 assessed competing vendors including Canon, Siemens, Fujifilm, and Philips. The research determined that BK Medical Holding Company, Inc. is the sole manufacturer offering a tri-plane transducer with simultaneous multiple biopsy needle capability, fully submersible probes, and compact footprint meeting all minimum requirements. Competing systems failed to meet the tri-plane transducer requirement necessary for three-dimensional visualization without changing transducers during intra-cavity examinations. DLA commits to continued market research for future acquisitions to enhance competition, noting that current contract vendors may add qualifying products throughout the year.

JUSTIFICATION FOR AN EXCEPTION TO FAIR OPPORTUNITY (JEFO)
BK MEDICAL HOLDING COMPANY, INC.
SOLICITATION: SPE2D1-15-R-0001
CONTRACT: SPE2D1-19-D-0023
BK MEDICAL HOLDING COMPANY, INC.
(1) Defense Logistics Agency (DLA) Troop Support, Medical Supply Chain, Capital Equipment Division, is the contracting activity.
(2) The action submitted for approval is a JEFO supporting the acquisition of one (1) bk3000 ultra-high resolution ultrasound system as required by Portsmouth Navy Medical Center (NMC). In support of this acquisition, the order will be placed under BK Medical Holding Company, Inc.’s basic Long- Term Contract (LTC) SPE2D1-19-D-0023, which expires 12 June 2029. This JEFO will allow an order to be placed without following the fair opportunity process.
(3) The total estimated dollar value of this action is
(4) The authority waiving the competition requirements is FAR 16.507-6(b)(2) (as implemented by DOD Class Deviation 2026-O0045 (MAR 2026)), only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized.
The required ultrasound system must meet the following minimum requirements established by Portsmouth NMC:
a. Must provide an ultra-high-resolution ultrasound system for Urological, OB/GYN and cancer detection diagnosis, including specific clinical capabilities as Tissue Harmonic Imagining (THI), Real Time Tissue Elastography (RTE), and Strain Histogram Measurement
b. Must have tri-plane transducers allowing for three-dimensional visualization of anatomy without changing the transducers during an intra-cavity examination/treatment
c. Must have at least three (3) active transducer ports
d. Must provide dual biopsy guides that allow for biplane and endfire biopsies without changing the transducer
e. Must have system software that can meet specific clinical needs, such as intra-cavity scanning, general ultrasonic examinations, intra-operative procedures with advanced MRI/CT image fusion, and enhancing biopsy precision
(5) Market research was performed in March 2026 assessing whether other vendors could provide an ultrasound system that meets all the minimum requirements of the facility. Market research findings
