JUSTIFICATION FOR AN EXCEPTION TO FAIR OPPORTUNITY
This is a Justification for an Exception to Fair Opportunity document issued by the Department of Health and Human Services (HHS), Administration for Strategic Preparedness and Response (ASPR), Center for Preparedness (CP), through the Office of Mission Acquisition Solutions (OMAS).
HHS ASPR seeks to award a non-competitive, firm-fixed-price (FFP) and time & materials (T&M) task order against GSA's OASIS Plus IDIQ contract (Contract Number 47QRCA25DS781) to J&M Global Solutions for professional administrative and technical staffing support. The requirement encompasses data analytics, information management, logistics, recovery operations, and technical assistance to ensure HHS and the nation's public health and medical systems maintain essential functions during emergencies and disasters. The task order is valued at an undisclosed amount (redacted) for a one-year base period. The contractor will support ASPR's Office of Data Analytics and Information Advantage (ODAIA), which develops tools for collecting, visualizing, and analyzing data to provide situational awareness and decision support across three critical divisions: Data Management & Governance, Data & Analytics, and Information Management & Intelligence. Additionally, the contractor will support the Geospatial Health System (GHS), ASPR's only geographic information system capability providing advanced mapping and geospatial analysis for real-time situational awareness and emergency response coordination.
The justification cites urgent need under FAR 16.507-6(b)(1), driven by cumulative delays from unforeseen federal and departmental actions including staff reductions, organizational restructuring, two federal government shutdowns (October-November 2025 and January-February 2026), and implementation of department-wide procurement consolidation. J&M Global Solutions has provided these services continuously since September 30, 2021 under the existing Professional Technical and Medical Support Services (PTMSS) task order. The Government asserts that failure to continue with the incumbent vendor will result in unacceptable service delays and mission disruption affecting national preparedness and public health emergency response capabilities. The contracting officer determined pricing as fair and reasonable under the overarching GSA contract with GSA-reviewed labor category pricing. The Government intends to establish a competitive task order against the GSA OASIS+ MA-IDIQ prior to the expiration of this sole-source action.
