JUSTIFICATION FOR AN EXCEPTION TO FAIR OPPORTUNITY (JEFO)

Defense Logistics Agency (DLA) Troop Support, Medical Supply Chain, Capital Equipment, is the contracting activity.

This justification is for the purchase of additional hardware, software and professional services to reconfigure the existing McKesson Digital Imaging Network Picture Archive and Communication System (DINPACS) located at the Naval Hospital (NH) Twentynine Palms on a sole source basis.

This additional purchase/reconfiguration of the current DINPACS, is available on McKesson’s DINPACS IV contract SPE2D1-1 - -000 which expires .

The total estimated dollar value is $273,835.

The authority under the Multiple-Award Schedule Program waiving the competition requirements is FAR 16.505(b)(2)(i)(B), only one source is capable of providing the supplies required at the level of quality required because the supplies are unique or highly specialized. The use of this authority is necessary in order to meet the needs NH Twentynine Palms. The Navy is requesting a reconfiguration, which requires additional hardware, software and professional services, of their current DINPACS due to several recent changes that have taken place. The current configured DINPACS is reliant on the database and voice recognition system at NH Camp Pendleton. Originally, the McKesson DINPACS at NH Twentynine Palms shared the network, a database and voice recognition with NH Camp Pendleton. However due to network changes, the shared network is no longer a viable configuration and the existing arrangement has become a patient safety issue. With the rollout of the new Defense Health Agency Medical Community of Interest (DHA Med-COI) network, NH Twentynine Palms and the NH Camp Pendleton are no longer sharing a common DINPACS network and have been physically separated which has created major challenges to using a common database. This network change has caused constant latency issues, lost database connections that have resulted in “broken studies,” where images and patient associations are lost, and lost dictations. Broken studies result in the loss of critical patient information. This reconfiguration will create a new database and voice recognition system resulting in an independent DINPACS at NH Twentynine Palms.

Further, the reconfiguration of a local database and local voice recognition at NH Twentynine Palms will eliminate the patient safety issue, latency, and save many hours of resolving broken studies. Due to the proprietary nature of the DINPACS system and the need for compatibility to the system currently in place, no other vendor is able to reconfigure the current McKesson DINPACS to create a new database and voice recognition system.

DLA Troop Support has already determined the price of the individual components and professional services that comprise the reconfiguration of the existing McKesson’s DIN- PACS to be fair and reasonable based upon the pricing evaluated at the time of award of McKesson’s current DINPACS IV contract and subsequent modifications.

Market research performed by DLA Troop Support among the DINPACS contract vendors confirmed that no other vendor could supply the hardware, software and professional services necessary for the reconfiguration of the existing McKesson system at NH Twentynine Palms.

7. There are no additional facts supporting this justification

8. Future requirements for additions or changes to the DINPACS at the NH Twentynine Palms may also be limited to McKesson. However, when the DINPACS at NH Twentynine Palms is due for replacement, DLA anticipates soliciting the requirement on a full and open competition basis.
