About this file
This is a Justification for Exception to Fair Opportunity document issued by the U.S. Department of Homeland Security, U.S. Citizenship and Immigration Services (USCIS).
USCIS seeks approval for a sole source extension to DV United, LLC via Modification No. P00039 to Task Order No. 70SBUR22F0000113 to continue system maintenance and security work for mission-critical information technology services. The extension covers an additional three-month performance period from September 25, 2026 through December 24, 2026, with estimated pricing redacted. The underlying task order was competitively awarded in July 2022 under the Chief Information Officer – Solutions and Partners 3 (CIO-SP3) Small Business Government-Wide Acquisition Contract (GWAC), which remains valid through October 29, 2026, with additional performance periods available up to five years on task orders awarded before December 31, 2028. The sole source justification cites RFO 16.507-6(b)(2), asserting that only DV United can provide the required supplies and services at the necessary quality level because the work is unique and highly specialized.
The services encompass Outcome-Based Delivery and Development, Security, and Operations Services (ODOS III) supporting IT development, security, and operations for major USCIS systems including the Electronic Immigration System (ELIS) and Global enterprise case management system. Key work includes developing one case management system supporting D1/D2 initiatives for 90% adjudication capacity, creating an enterprise Notice to Appear (NTA) service, enabling Final Automated Biometric Identification System (IDENT) capabilities, maintaining enterprise benefits case management, supporting interactive capabilities with partner agencies (ICE, CBP, Department of State), and providing proactive monitoring, security patching, and incident response. USCIS determined that no other vendor can complete the work at acceptable quality levels without sufficient transition time, and the pending GAO protest on the competitive ODOS 3.1 recompete creates urgency for maintaining continuity. The Contracting Officer certified the extension price as fair and reasonable based on CIO-SP3 labor rates and ODOS III competition results.
