About this file
This document is a Justification for an Exception to Fair Opportunity for the procurement of Getac laptops and associated hardware to support the Joint Mission Planning System (JMPS) software used by the Navy and Marine Corps.
The key details are: NAVAIR has a requirement to procure up to 3,000 Getac S410-G5 laptops and up to 150 spare docking stations for a total estimated value of $12.4 million over FY24-FY25. This brand name sole source acquisition is being conducted as an exception to fair opportunity based on the Getac laptops being the only model that meets the technical specifications for JMPS software compatibility and performance requirements. The procurement will be issued as a competitive Firm Fixed Price delivery order under the PMA-281 Software/Hardware Indefinite Delivery Indefinite Quantity Multiple-Award Contract (MAC), with the Getac laptops competed as a Small Business Set-Aside. The ordering period is two years from the date of award.

IN REPLY REFER TO:
JUSTIFICATION FOR AN
EXCEPTION TO FAIR OPPORTUNITY
1. Contracting Activity.
Naval Air Systems Command (NAVAIR) Headquarters
2. Nature and/or Description of Action being Approved.
NAVAIR has a requirement to procure laptops to be utilized for the operation of Joint Mission Planning System (JMPS) software in support of Navy and Marine Corps aircraft.
JMPS software is a Windows, PC-based common approach that utilizes commercially available Off-The-Shelf (COTS) computing. This acquisition is being conducted as an exception to fair opportunity by restricting consideration to authorized resellers of Getac laptops and associated hardware upon the basis of a brand name justification. The resulting procurement will be issued as a Firm Fixed Price (FFP) competitive delivery order under the PMA-281 Software/Hardware Indefinite Delivery Indefinite Quantity Multiple-Award Contract (MAC). The Getac laptops and associated hardware will be competed as a Small Business Set-Aside amongst the MAC small business vendors. The ordering period for this delivery order will be two years from the date of award. Justification for an Exception to Fair Opportunity only covers the portion of the acquisition that is brand name.
3. Description of the Supplies or Services Required to Meet the Agency’s Needs (including the estimated value).
This contract will include procurement of the following items:

4. Identification of the Justification Rationale (see FAR 16.505(b)(2)) and, if applicable, a Demonstration of the Proposed Contractor's Unique Qualifications to Provide the Required Supply or Service.
FAR 16.505(a)(4) – The requirement is for an item peculiar to one manufacturer.
As defined in FAR 6.302-1 (c), the required Getac laptop and associated hardware is specific to one manufacturer, therefore, only a brand name sole source is available. This brand name was identified through a sources sought posted on 3 July 2023 to seek potential laptops capable of supporting JMPS software requirements.
One vendor responded to the sources sought with a capability statement for two manufacturers’ models, Getac S410-G5, and Dell Precision 7680. Of these two models, only one passed the initial requirements, which was the Getac S410-G5. The Dell Precision 7680 was eliminated as a candidate for further evaluation as its configuration did not meet technical specifications. The Dell did not meet the requirement of a removable drive, nor did it possess the required 9-pin Serial Port. Furthermore, the requirement to be able to provide the same configuration for the two-year POP could only be confirmed to be met by the Getac model, and not the Dell model.
The Government procured the proposed Getac laptop configuration via a purchase card. The Government performed a thorough in-lab engineering evaluation and assessment of the Getac S410-G5 to ensure capability to meet the specifications developed using the Mission Planning requirements of the fleet.
The following factors were taken into consideration during the evaluation: (1) Ability to meet technical specifications, (2) Ability to meet logistics/supportability requirements, (3) Overall performance with target software, (4) Usability/Human Factors, (5) Security, and (6) Compatibility with future software configurations. All results were documented and released in a formal report.
Only the Getac S10-G5 candidate system was found to be acceptable across all evaluation factors, and was selected as the FY‐24 and FY-25 system to replace the aging systems based on the system’s hardware configuration and overall performance.
5. A Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable.
The Contracting Officer has determined the anticipated cost to the Government of the supplies covered will be fair and reasonable based on adequate price competition.
6. Any other Facts Supporting the Justification.
N/A
7. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers that Led to the Exception to Fair Opportunity before any Subsequent Acquisition for the Supplies or Services is Made.
The next bi-annual technology refresh period (FY-26) will require a new sources sought and engineering analysis, giving manufacturers a renewed opportunity to submit a product for consideration that best meets the mission planning needs of the fleet.
