JUSTIFICATION FOR EXCEPTION TO FAIR OPPORTUNITY (JEFO)
(1) Defense Logistics Agency (DLA) Troop Support, Medical Supply Chain, Capital Equipment Division, is the contracting activity.
(2) The action submitted for approval is a JEFO for the acquisition of
The authority waiving the competition requirements is FAR 16.505(b)(2)(i)(b), only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized.
This device will support forward deployed forces and will be a primary means of diagnosing internal injuries due to trauma associated with combat. Injuries such as combustive blasts, falls, punctures from high velocity projectiles, broken bones, and damage to internal organs, and head trauma require rapid detection in order to sustain life and operational capacity. The Navy has standardized on this system, which is the only approved deployable system.
(5) The contract pricing has previously been determined fair and reasonable via comparison with commercial pricing and other than cost or pricing data. The Contracting Officer determined that the subject procurement represents the best value to the Government.
(6) The Services continue to perform market research on the availability of deployable C-Arm's to meet their needs. They have already begun the process to find the next generation deployable C-Arm, which is expected to be procured competitively through DLA Troop Support. An Integrated Procurement Teams (IPT) consisting of the Navy, Army and Air Force is currently finalizing market research and development of the requirements.
Standardization market research and requirements development have been continuing. Once completed, a competition to select a vendor will be conducted, followed by environmental and operational testing, which will incorporate a risk management framework (RMF) testing phase. It is anticipated the entire process will take at least two years to complete.
(7) There are no other facts supporting the use of this JEFO.
(8) As the Contracting Officer, I hereby certify that the information contained in this justification is accurate and complete to the best of my knowledge.
JUSTIFICATION FOR EXCEPTION TO FAIR OPPORTUNITY (JEFO)
I attest that technically valid Navy standardization of Ziehm Solo Digital Mobile C-Arm Premium Portable m2, as the only approved deployable system, is a solid basis for issuing this JEFO.
