About this file
This document is a Justification for an Exception to Fair Opportunity (JEFO) for a 12-month contract extension to provide Clinical Staffing Services in the Eastern Region of the United States. The services include occupational medicine, medical employability, and fitness for duty assessments at multiple Federal Occupational Health (FOH) Service Provision Sites. The contract will be awarded to the incumbent contractor, who is the only responsible source that can provide uninterrupted services without any performance risks or delays. The contract extension is needed to ensure continuity of services during the solicitation and transition to a new 5-year consolidated contract, targeted for award by Quarter 4, Fiscal Year 25. The period of performance is November 1, 2024 to October 31, 2025, with a total estimated value. The JEFO cites the incumbent's existing staff, security clearances, and training as the rationale for the sole-source award, as transitioning to a new contractor would cause significant delays in service.

This 12-month contract extension is to ensure continuity of Clinical Staffing services in the Eastern Region during the solicitation and transition to a new 5-year consolidated contract, targeted for award by Quarter 4 (Q4), Fiscal Year (FY) 25. The period of performance is 11/1/2024 -10/31/2025 for a total dollar amount of
5. Authority and Rationale:
“ is the incumbent and currently the only responsible source that can satisfy the agency's requirement and minimum need of uninterrupted services without any degradation. The proposed Contractor will deliver these services with no transitional start-up/mobilization delays, thereby eliminating performance risks and potential for schedule delays. employees are already in place, they already have their security clearances, computer access, access to case files, and they have been trained to provide FOH services according to FOH processes and service requirements. The transition to the new contractor will take several months and FOH would not be able to fulfill our contract requirements with our customers, and our customers would be unable to provide services.
The Contractor, , can deliver these services with no transitional start-up/ mobilization delays, thereby eliminating performance risks and potential for schedule delays. Additionally, has operated this contract for the last 5 years and employees are currently performing these services under this contract, and have obtained the required security clearances, computer access, access to case files and are trained to provide FOH services according to FOH processes and service requirements. If a new Contractor is to perform this requirement, it would require additional time to on-board their employees (e.g. security clearance, computer access, training, etc.), which would further delay the services for several months.
The transition to a new Contractor to ramp up to on-board employees for security clearances, computer access, training, etc. resulting in delay/ interruption of services, and FOH would not be able to fulfill the contract requirements with their customers (e.g. physicals, vaccinations, medical testing). This will have a negative impact on the quality standard and performance of this contract due to additional time, which can result in additional cost, to bring the new Contractor up to speed. Whereas the incumbent Contractor, is readily available to continue services without any delays to service. In order to mitigate cost and performance risk, the current contract can be extended to allow additional time to transition services to the new 5-year contract.
7. Fair and Reasonable Price/Cost Determination: I hereby determine that the anticipated price/cost for this contract action will be fair and reasonable.
The IGCE was developed comparing current various salary/benefit rates from onetonline.com, salary.com, and Department of Labor (DOL)/Service Contract Labor Standards (SCLS) for the positions required for this extension. Additionally, a increase was included to the postion rates. The Contractor's proposed price will be compared to the IGCE to perform the price analysis to determine it fair and reasonable for the level of effort.
